Backpacks
« on: July 02, 2009, 02:49:47 pm »
Hi. regarding my backpack and trolleys I have been selling for some time both from my website and ebay. If anyone has wondered why my trade mark has disappeared it is because someone else owns the words "Reach"  and  "Wash" so I cant use them in my advertising. Perhaps they are being "Ironic" in trying to squash the small man: but whatever the reason I hope no-one objects to me using this forum to set the record straight.

It's a silly situation John. Have you got access to a legal team through an organisation like the FSB? They might be able to help.

A friend suggested the logo "Up Yours".    Regarding the legal aspect of the name can someone really own a name which includes such common words as Reach and Wash which is after all what many window cleaners refer to as the service they are offering. To me it is a bit like Hoover registering "vacuum cleaner" and saying it is theirs

Can I clarify things a bit

Ebay pulled all my adverts  It would appear that ebay didnt even check as my logo and wording is obviously not that of Ionics but I do use the words "reach"   and "wash"  I considered it a generic name for wfp.

This is the letter from Ionics

"I am going to have all of your listings with the words Reach2Wash removed from ebay. Reach & Wash is a registered trademark of Ionic Systems Ltd, changing the & to a 2 is passing off under our trademark and is not allowed. I must also insist that you destroy all of the Reach2Wash stickers that you have on your equipment."

I have thought of a logo with a little cartoon guy holding his pole up and the words UP YOURS across his back but I dont think Ionics would see the joke.
I'm glad I dont take life as seriously as Jason Mawlam although he did send his regards at the end of his letter. That was nice wasn't it?

it's a joke
my mate got the same letter, he goes by reach'n'wash
he doesn't use the wfp man Logo that ironics designed or any logo for that matter. and in no way is that "passing off"
this guys obviously out to protect there 'brand' just like some window cleaners will "threaten" violence against someone canvasing their work.

if he's that bothered about "passing off" he'll go to court. but they know there aint know chance a judge will do anything about reach2wash reach'n'wash or any other kind of reachwash derivitive.
just like coca cola, pepsi cola, panda cola, hell what about rola cola
in lidl the other day they have there own corn flakes, honey nuts flakes, rice crisps, wheatbiscs,   ::)
you get the idea,

you keep going John and put Ebay right if they remove any items.
and ignore this fool
