Cannot see the problem unless your passing yourself off as a s/m franchise, I can go and get a yellow extracta machine put it in a yellow van infact there are plenty that do. There are also plenty guys advertise the fact they are ex S/M, do S/m come down hard on  these? cannot see how they can.

I really don't think the colour will bother SM.

The reason the buyer will want to change the colour is because it's yellow.


This is over priced, should be £ 10k (5k van 5k machine) and that's generous.

I imagine the you are talking about the sort of thing that Alltec do.  There is no protective coating apart from being part boarded on the sides and on the roof.  We are not longer vat registered and are now prepared to discuss the initial asking price less any VAT element.

The colour of the van AND the machine might be a problem - Its a tough one the colour issue BUT you can't just assume SM would not be successful in a 'passing off' action if they wanted to get legal - you could ask them of course - fact is, if it was a drain jetter in the back then they could not do anything about it but it is a carpet extractor and that is precisely what the 'passing off' case law will consider - very much depends if they wanted to be spiteful or are not that bothered!

If you put new graphics on it completely dis-similar to the SM brand it might help your case
 
They would be laughed out off  court , love to see them try....

David I have da ja vue, I'm sure a couple of months ago you was asking for x2 hose ramps and some guy in Somerset came on with two for sale at £150 each.(good price) Did you not buy them? or are you collecting them ;D

It's tricky getting a value of TM and van but what I would do is look up the book price of van, for the TM since it's a HM I would call HM and ask them, they must be the best placed to know used value.

Personally I would take the total add £1k advertise and drop until I got shot of it.

Not neccessarily Hilton - thats why I commented - I worked for a company where we produced a product that was deemed to be 'passing off' as another product and it is no joke - in fact we knew nothing about the other product but thats no defence - it depends on how keen SM are on protecting their trademark and the colour is very much part of that IP - it all depends on how highly they rate their profile - it would certainly not be laughed out of court...
