Holiday pay

Hi

Could anyone help me work out what the holiday entitlement for a person who works 16.5 hrs per week. I have looked at loads of website but can't find what i'm looking for. She works 5 days per week but the hours vary on different days, for instance she works 4 hrs on a mon and only 1 hr on a thursday so it would be unfair to calculate her holidays in days. I was wondering of we could calculate her holiday in hrs so she can request hrs off instead of days. Sorry if this is slightly confusing, I'm tired and hungry and the christmas spirit is wearing off FAST!!

Hi

Basically the member of staff is entitled to a minimum of 66 hours holiday pay per annum including bank holidays based on a contract of employment for 16.5 hours a week, you could be generous and give the four weeks plus bank holidays.

Sorry my brain is so behind tonight it is embarrasing. Dont need that calculation I just need to wake up a bit. Is it really as simple as that? weekly hrs x 4?

Hi Jo,

Yes weekly contracted hours x 4 including BH's, as I said this is the minimum entitlement you are required to give.

And if the hours vary each week, then when they would like a week off, calculate the average hours worked in the four weeks up to the requested holiday and base the holiday pay on that figure.

Hi Tim

If a worker has no normal working hours then a weeks pay is the average pay received over the preceding 12 weeks, any week for which no pay was due should be replaced by the last previous week for which pay was due.

If Jo's employee is contracted for 16.5 hrs a week he/she gets this entitlement x 4 minimum (66hrs) as it would state in the contract of employment, overtime absence etc wouldnt affect the holiday pay.

Well done, you found the deliberate mistake!  ::)
I think we have talked about this about a year ago and both mentioned the 12 weeks to work out the average. My mistake. Don't know why i put 4 weeks when we work to 12 weeks!! Must be the weather......or old age!!

i remember seeing a simple calculation for this somewhere it may have been on the acas site which i think is www.acas.org.uk

Hi,

A employee acrues 1,66 days per month holiday pro rata. although they domt'have to wait until they've acrued enough holiday to request paid holiday.
