I've been to court to recover money, but need your help

Hi all,

Last November I did a large soffit and fascia clean on a care home; a full day from 08:30 to 17:30. Soaked to the skin in the pouring rain. The agreed cost was £280. Despite leaving an invoice, several phone calls, my red letter and assurances I would be getting paid imminently I am still awaiting payment.

I handed it to the Thomas Higgins Partnership (who have been excellent) who issued a Letter Before Action: no reply. it went to court, and no defence was entered by the care home. Judgement was found against them and a bailiff was sent round to seize goods to sell to get me the money I am owed. I have just heard that the bailiffs say it is a private house and there are no goods to seize. This is incorrect and I have sent Thos Higgins exact location together with a foto of the property as I think they went to the wrong address (it is hard to find). Let's see what happens.

Anyway, the upshot of it all is that I am still out of pocket for the cost of the clean plus court fees of a couple of hundred. I'm pretty chilled about it to be honest, but I 'aint the type of guy to let it lie and would like to do my utmost to recoup the money.

Has anyone else been here before? What did you do? Any suggestions?

For light relief it would be good to hear how windies you know of got there revenge for none payers, not that i'd ever consider that type of thing!

Personally I would let it go. Seems a lot of hassle for a days pay.

Good on you mate,

Even if it cost me £300 to get the £280 I'd see it through to the end.

I got ripped for nearly £7000 2 years ago and I'm still fuming thinking about it now.

never let them get away with it.  Us WC have a rep for letting people rip us off. We need to stamp it out

I tend to rid the hastle though by banging on a load od extra charges, and selling the dept onto someone else.  I get paid, and they get screwed, and no stress to me

In short I was subbing a load of abbey banks and boots from a woman who subbed from maclellans,

She paid well to start but the payments soon dried up and the final figure was nearly 7k.

After abit of digging I found out she was a proper crook, fraud and many other offences.

I went to her house with another few guys who had been "done" too and told her to pay up or I was going to arrest her.

She didn't pay so I arrested her on suspicion of fraud and dialled 999. The police came and did a check on her and she was also wanted by them under another name.

She got locked up and taken away in the police van and I emptied her garage of 5ks worth of kit with the blessing of her partner.

The company went into liquidation and nobody got nothing.

She owed over 100k to the hmrc and wouldve been dealt with accordingly.

All in all it was a bad year.

i would find out where they stop cock is and turn it off and pour cement in to it,  that alwasy annoys them

I hope I'm wrong but are you 1,000,000% sure that all the details on the court papers are correct

Name of owners
Name of business

I had a right mare last year when I took the local Ford dealership to court. Tracking down the true owners and trading name of the dealership went on and on. I stuck with it and when we got to court the guy in charge of the hearing ripped their rep to pieces over who actually was running the business and who owned it.
There was trading as this and trading as that with numerous addresses and owned by x company who are owned by y company etc etc.

But I got my money.

As for your lot not finding anything to take, rubbish. there must be an office that contained at least some chairs as these wouldn't be owned by the residents there.

Is the care home owned by a limited company? If so if it is always better to sue an officer of the company, ie a director at their home address, all this information is available from companies house.

might be a good idea to name and shame em! so noone else gets burned!
and you must be mad doing that for £35 phr, presuming you had an hour break throughout the day!
i would charge at least £40-60

i did one today took 2 1/2 hrs including windows, only charged £100. i was hoping to get out of there in 2 hrs  :-[

I have one going on now - I looked at Thomas Higgins but decieded on Daniel Silverman. I paid a one off fee related to my turnover get t&c that I put on the invoices. I am owed £288 by a pub / wedding venue but their bill is now over £500 with interest, fees etc. They make their money as the debter has to pay their fees and if he pays the original £288 then he is only paying the interest with the original bill remaining. Since we have included the t&c on our invoices even the slow payers seem to sharpen up with remittance
