van insurance claim

hi.

had someone whack into my van while it was parked, and i was working  :'(

Not too bad, 20 ish yr old girl reversed of big house drive across the street and bang goes my van.

drivers door pretty dented, open and shuts though.

was taken payment at custy's door nearby.

i ran back to van as the girl's car (corsa) looked liked it was in the process of driving off :-\


girls mum comes out and after seeing her daughter's car, started spouting off how it was my fault for parking in a stupid place ::)


i was parked opposite their drive by a normal pavement not a dipped drive and it was a normal width street.


the thing was the houses drive had loads of room to turn a round on.


the mother wasn't intrested in going through insurance, due to high premiums on her girls insurance.



I have notified my insurance, i'm 3rd party.

my broker past me through to help hire, who are dealing with my repairs and courtesy van.



My question is on paper work i got threw from help hire it's stats they pay for all costs and then claim back from the other parties insurance.

the thing that worried me is it stats they pursue the costs for 49 weeks and then basically if not solved, come after me for monies ::) ???

I've never heard of this is this because it's commercial insurance?

has put the wind up me a bit.

got paper work here to sign and send off.


anyone here had experience of this?

just fill in your paper work, with as much details and pics as possible, sned it off and forget about it, that is what your insurance is for, they will take care of it,  they cant chase you for the money, if the insuance cant agree whos fault it is it will go to court then the judge decideds, whos fault it is

i have got a case at the mo, becasue a lad in a 106 claimed i pulled out on him in a white transit whilst he was doing 70 in a 30, and smashed his car up  basically i was driving up the street and he crashed and only had 3 party insurance, the pics and skid marks prove it was all his fault


did the mother want to just pay for the repairs? and has she accepted the blame

id phone the police to get yourself covered on that one
Also i thought it was an offence to reverse into a main road acording to the highway code?
whether she is interested in going thru insurance or not it is her legal obligation to give her insurance details i would have thought

please correct me if im wrong

I would say if you are parked legally its got to be her fault mate....go for it, when the girl gets the insurance claim papers mummy will ring you and settle

ps dont forget the "whiplash"  ( cos when you were collecting the money from house opposite, you heard the "crunch" and turned around REALLY quickly................))

if it isnt settled by the time your insurance is up for renewal,  they class it as your fault and put up your insurance, untill it is settled and then give you a rebate,   i had this done to me  it went up from 300 to 900 and then they refursed to insure me because i argued it, so am with some one new

thanks guys.

daz sounds as if your as lucky as me.

I had the girls father leave a couple message on my phone,  i basically blanked his call.

had dealings with people in the past there all apologetic face to face you do them the favour of not going through the insurance;  get a quote for repairs and the other party starts telling you it's to dear and they want you to use a garage of their choice ???

also there's the matter of a courtesy van while mine's being repaired, don't want to be indoors twiddling my thumbs waiting for my van.

My customer has begrudgeingly  offered to be a wittness "i didn't see it but heard it"

custy see end result corsa stuck on my van :D

to top it off been off since friday snow; wont be back monday still to dangerous here in waltham abbey  essex :'(

If i went out monday i'd probably break bones.

can't wait til  2010.

good riddance 2009, nothing but a string of bad luck for me.

I would inform the police of the accident just in case there are any problems later, failing to give insurance details. If she did attempt to drive off possible failing to stop at an accident.


you do not need to speak to the police as no-one was injured

you do need to exchange details though, as you know her address thats half of them, you were stationary so its 100 % blame to the other party

ref the courtesy van, its a tough call, as they will have to get the costs back of the other people ( not insurance company )

i would just inform your insurace company i get it fixed by them, you dont need the hastle just to save a few quid for the people from the big house

you pay insurance, they pay insurance, let them sort it out, you will have 2 phone calls and its all out of your hands

thats how i see it.

yep police are only intrested if anyone is injured.

as you said don't need the hassle of dealing with joe public, enough of that being a w/c.

sorry what was your point on courtesy van went over my head.

I thought as other party is to blame they will be liable for costs or rather their insurer.

have contacted my insurer and they have contact other party on my behalf

went to repairers on friday for them to do estimate and send off.

wheels in motion, just need to put my name on dotted line on agreement, as said in first post wording put wind up me :o

with my experience its loads of phone calls form filling and waiting plus you have to pay thr excess if its your fault or not then your soliciter claims it back for you  good luck.
