wpf girl falls off bike pt3

so there we have it the end of the story,,,after about 10 attempted phone calls to this guy we manage to get hold of him,and i must say how supprised i was at his responce,,,,just forget it he said,,,i was a bit hot headed over it,,,well blow me down with a feather i could,nt believe it,,after all that worry and sleepless  m nights i,ve had,,i did,nt mention anything about data protection act or anything ,,now the question is should i phone the police back (like they told me to do on tues) because they want to talk to me about how he got my address without asking anyone,or the fact that my van is not sign written,all he had to go on was my number plate,,,this  brings the data protection act to light,,or should i just let it go,,,a part of me want,s to give him some of the pain back that he gave me,but this might just make him mad and determine to press ahead with his original claim against me,,,,,,kev

Glad it worked out ok in the end,.. the stress of that kind of situation far outweighs the financial side of it. I'd recommend talking to him 1 last time and trying to get it either in writing, or recording the phone call,..

Get it in writting FIRST that they do not intend to proceed with their "claim" and THEN decide what you are going to do......  ;)

Good news - but what to do?

You heard the phone conversation - does he sound on the level? Do you need to cover your back? I don't know - tough call.

Part of me says: Send him a letter for the attention of his girlfriend (it's her claim after all) stating that you understand she will not be proceeding with her claim and that you were surprised she even entertained the idea what with her riding on the pavement illegally and all. Explain you are minded to inform the police of her actions but that an "in writing retraction of the claim" would allow you to overlook it.

Another part says: Let it lie, log the call and it's details - but could it come back and bite you?

Yet another part says: Speak to your insurers and take their advice outlining everything before you do anything... but do you want them to know?

Thinks ...

Hmmm ... on balance I would speak to my insurer and see what they say.
It's a game of three halves!

I wouldn't be keen on taking revenge, you never know where it is going to go. If you have managed not to call your insurance so far then I wouldn't be too keen on calling them now, just the fact that someone might claim, your insurance might get you to pay your excess up front and then slap extra charge for no claims bonus next year.  You will get that all back but in a few years time but might have to pay now.

However it would be interesting to see where the boyfriend got your number from, he seems to have backed down fast.  I wonder if he realizes he has made a mistake, a phone call asking where he got your address from and not taking any excuses might completely put him off of making a claim (just in case there is still a chance).  Even tape the call for evidence.

Glad its had a good outcome, and you can put it behind you now
BUT it serves as a wake up call to us all, we should heed the warning that this sort of thing can easily happen.
We live these days in a "where theres blame theres a claim " society and we need to be prepared for this by reviewing our working practises and limiting any forseeable hazards to a minimum.

thers two ponits one you shud have told insoranc co , and you shud not have sad note a bute the hose when she fell of , thats the resun for gredy boy frend , hes proberly an x now

I would still advise the insurance company you have 3 years to make a claim ...see what they say.
As for the police I have to admit i would be tempted to push it a little ... they may scare him off from doing this to someone else. Even if he pushes the claim in the future your insurers will be sort that for you ...it is what you pay them for

Someone rang me lately over an issue i had just for some advice, someone i knew from a long time ago, rang me out of kindness. Told me to not hold grudges and just let things go, said hes been there done that...just forget about it, cut your losses and be done.

That convo really changed the way i have been thinking lately, let it go, carry on as nothing happened and try not to get into stress as its really not worth it.
