Late Payment Legislation
« on: March 20, 2009, 06:52:56 pm »
Hi all, was just wondering if anyone has used the late payment legislation to chase bad debts and if so how successful was it ? Have been working for a letting agent who is extremley unrealiable at paying and am thinking of using the legislation to claim back some compensation and interest for all late invoices.

Used to subsciibe to "Better Payment Practise" - complete waste of time. If they are determined not to pay then you have a fight on your hands. Have also tried small claims court, but if they are bigger than you well...............

Hi there, I have the message at the bottom in every proposal, contract and on every invoice I issue. I've never actually had to go down the small claims route before, but I know people that have and it consumes time. You need to get the client to sign to an agreement for credit terms. Hope this helps. Are solicitor would be of good help writing the terms and conditions and would charge about £100 for a basic one. Hope this helps.

We will invoice at the end of every 4 week period for work that has been completed and in each invoice it shall state the service/products and the provision dates it covers. You then have 28 days after the date of the invoice to make remittance of the invoiced amount. If you would like to discuss anything please contact me on 01234 567890. We understand and will exercise our statutory right to claim interest and compensation for dept recovery costs under the late payment legislation if we are not paid to agreed credit terms.
