paying travel time

Hi,

I have been running about three years now but only recently taken on more employees....wish i hadn't!!!

Took on a girl and explained that whilst she was a cleaner she only got paid for the jobs that she did and not travel time inbetween...anyways she has been working one week and kicked up about it saying that we should be paying her travel time...we pay more than minimum wage to reflect this and she doesnt drive we do the driving so she just has to sit there and drink her coffee....she says she has contacted ACAS and i am not sure how i stand...i pay all my supervisors time for travel and mileage allowance..but general cleaners just get paid for time at jobs...tho i will pay more if they are held up...i'm confused!! what do you guys do?

I pay travelling time, I wouldn't like to spend 30 mins +sometimes to get to a clean and not be paid for my time. If they are making themselves available for work they should be paid for their time, but it also depends on if the money is there to do so if its been allowed in your costings. Also if your paying your supervisors for the travelling time which is prob. at a higher rate not really fair that the cleaner isn't getting it. But thats only my opinion, it's not easy is it keeping everyone happy.

I pay my supervisors travelling time because they are driving...riles me that I would have to pay someone just to sit there and file their nails...we pay over the minimum rate, so if i had to pay them i would have to review this..think i will have to take legal advice

Also, if travel time goes over 20 mins we pay it.

Hi

I guess in this PC mad world we are now living in, best to treat them all the same. Or some no win, no fee lawyer will have you in court for some form of discrimination or some other trumped up charge.

So if you're doing 5 jobs, 1 hour each and 20 mins travel between, that's 1hr 20 min travel (excluding getting there and leaving the first and last job) you would need to be paying them over £1.50 above minimum wage for this to be fair.

Would you want to not be paid for an hour and a half of your time??

Sorry if this comes across as rude, it is not my intention, I just know I probably wouldn't take a job where they didn't take that into account.

If they had to travel themselves then they would spend about and hour doing so and I wouldnt have to pay them,i do it this way cos it makes life easier for everyone.  And yes i used to do it myself when I worked for someone else.  If i paid them like this i wouldnt be making any money.

All my other staff are very happy with the situation as they have no travel costs to work and are picked up from their door and dropped back to it. normally at the most we spend 3/4 a day travel time.

I sympathise with you here.

If the cleaners are picked up from home then they shouldn't get paid for travelling to work or back from work but because they travel through the day to each job some people may find this unacceptable. Personally I would probably pay half the travel time but the law would actually say that as they are 'working' from arriving at the first job until they leave the last so they should be paid.  To get over this you could say each job is 5-10 mins less (depending on distance to next job) than present to allow for travel time and this will cover travel costs.

This seems to be a bit of a grey area...ACAS weren't sure and HSE said i didnt have to pay her...!!! I try to make sure all my jobs are within ten minutes of each other...but also the girls often ask to stop to get a drink etc...am i suppose to pay them for that??? this is a minefield and I think I am going to get some proper legal advice so i know that i am getting in right.  I dont want to be unfair to anyone but I pay a good rate of pay and everyone else is more than happy.  I wondered whether paying the general cleaners a mileage rate of 15 per mile might suffice?
