Need help with Sub Contractors and Insurance

Just talked to my insurance company and they are telling me I have to add sub-contractors on my insurance as if they are employees and I get charged the same.  My sub-contractor has his own insurance both public liability and employers liblility.  Now it seems to me the insurance companies would be getting double for the same person by doing this.  If I am not mistaken, only one policy will pay out, and it would be his so why would I have to pay.  Seems like reason for a class action law suit to me if it is true. 

Can any one tell me how they handle sub-contractors and insurance issues.

YES you get a copy of the sub-contractors insurance and keep on file, if a claim is made your insurance company makes a claim against his insurance company

Here is what we get are subys to fill out before they start with us (copy & paste to word file)

      Please Note. Your sub contract work for Smart Cleaning group will be inspected at various times during the contract and will need to be signed off as satisfactory by our Contracts Manager. Paperwork will also be supplied to you which will need to be signed on satisfactory completion of the work by the client. This paperwork should be returned to us together with your invoice.

We may wish to contact your Bank for a reference, and will also need these details so that we can pay you on completion. (Please submit details below)

It looks like a great form, and thanks.  Does this prevent my insurance from increasing?
