Bank charges

 I know this is not really relevent to window cleaning but seen as were all doing the same job and i see you all as friends please dont move or block this thread..............


Have any of you heard about reclaiming back the charges that banks like to charge i.e £30 for going over your overdraft £30 for missed direct debit does this sound familer?

You can claim back every charge over the last 6 years

Ours was £1600 in 6 yrs (had some very poor times) Claimed back £1400 took 2 weeks ;D ;D ;D

Oh what the!!! I needed this! Reading now!

I just got charged £34 + £25 for overdraft and failed bank transfer, just because the exact same day a Direct Debit went out, which shouldn't have gone out.

you have to write a letter and appeal for the charge even if they have charged you £300 its still worth filling in the form

 Due to recent media coverage on bank charges I now believe that you, [your bank’s name] have been charging me charges that are contrary to the Unfair Terms in Consumer Contracts Regulations 1999. Schedule 2 (e) of the said regulations gives a non-complete list of terms, which may be regarded as unfair, such as a term that requires me as a consumer who fails in his obligation, to pay a disproportionately high sum in compensation

 I believe that your charges are disproportionately high and therefore they are contrary to the Unfair Terms in Consumer Regulations 1999. In addition I believe that your charges are a Penalty. Penalty charges are irrecoverable at common law. The precedent for this was Dunlop Pneumatic Tyre Co Ltd v New Garage and Motor co Ltd [1915] AC 79 along with Murray v. Leisure play [2005] EWCA Civ 963. It was held that a contractual party can only recover damages for an actual loss or liquidated losses. It is clear that your charges do not reflect any actual and or real loss.

 Furthermore if you fail to comply with this letter, I request without further notice a breakdown and proof of all costs involved, in regards to your actual or liquidated losses involved in any breach of contract to which these charges relate with yourselves, and that these charges reflect your true costs in relation to the said charges, and are proportionate to the charges levied on my account as defined in Unfair Terms in Consumer Contracts Regulations 1999. Schedule 2 (e).

Therefore I require you to refund me a total of £[XXX.XX], representing the total, unlawful amount charged during the last 6 years.

 I hereby give you 14 days to refund the charges back on to my account. For the avoidance of doubt, if this is not done within 14 days, I will commence my claim in the courts without further warning. This action will inevitably involve you in additional costs.

I also hereby request a detailed report of which clause in your terms and conditions each charge has been applied against.

Awesome pal, thanks a bunch.

Just called my bank up, and they are gonna pay back the £34 + £25, so that's that. Never had anything else apart from that, been only for a while here in the UK.

I've done this and mentioned it on a post in the off-topic section.

I claimed about 400 quid back from Wor Lasses bank.

It really does work, but you have to be organised and determined.

Which Magazine's website covers this well and provides all the information and standard letters you'll need too.

Thats what I'm hoping, but I have heard of one guy who actually got as far as getting the baliffs to give his branch a visit before they paid up!

Not sure if this is slightly dependant on the value of the charges or not.

Just got to the stage off taking Barclays to court only cost £120 online and will get that back when they phone up and grovel.

They phoned my wife last week and said they'd increase theyre offer by £150 still some £550 off the total.

Now its gonna cost them an extra £120 plus 8% int p.a. from the start of the first charge.

Haven'y yet but if they try it they'll gonna get taken to the ombudsman.

He has just ruled in a customers favour of a bank who closed someones account and they had to pay £120 in compensation. This will now set a precedent in all customers favour.

I posted my letters so the bank would have received them on the 1-3-07. Everyone seems to think it will take 2 weeks to get a reply so we will see.  I read on line that the banks are getting slightly quicker at settling as more and more people are claiming their money back.
Saying that though.  My brother went into the bank to ask for his statements for the last 6 years and a month later he still hasn't got them.  They charged him a tenner for the pleasure.
 I got my letter template from the moneyexpert website. 
Now we play the waiting game.
