Strange TUPE information HELP
« on: December 20, 2016, 04:03:48 pm »
Hi all

Hope someone technical can help! In the middle of a tender at the moment for 4 schools and the TUPE information is stuff I have  not encountered before!!

Firstly the sick pay entitlement says that the staff are entitled to  '156 + 156'? Has anyone ever encountered this sort of term?
Some have 104+104,52+52 or 26+52. Any ideas what this means?

Secondly, when you tender do you most of you allow 13.8% employers NIC in your tender for the total wage bill or do you allow for the £156 allowance of each person before you deduct the 13.8%. The reason I ask is that most of my current staff have more than one clean so allowance will already have been used in most cases.

Look forward to hearing from you!

Thanks

Tim

We had tupe staff once their holiday pay was calculated as per the table below
Full Pay                                                  Half Pay
1 Month (26 days)                1 Month (26 days)
After 2 years’ service
2 Months (52 days)               2 Months (52 days)
After 3 years’ service
4 Months (104 days)              4 Months (104 days)
After 4 or more years’ service
6 Months (156 days)              6 Months (156 days)
On top of this they also got £1 an hour extra for just turning up!!
Needless to say we managed them out of the business

Thanks for the response so I will assume that the longer service guys are 156 paid sick full and then 156 at half pay! Blimey! On top of that they get final salary pension and 34 days holiday, only work term time but get paid for 52 weeks !

That's about the size of it.  Can I have a job there? LOL
There are ways round it but as the law interprets each case on so many factors and there are no hard and fast rules it is a veritable minefield.
