Have now spoken to my accountant, companies house and to a solicitor from the FSB, who all advised to write to the company involved complaining etc, but both basically saying there is a case for them to take me to court to force my company name change.
Because they are a ltd company and were there 1st with the name.
Was going to do the neccassary writing, but as Im very busy at the moment and cant really find the time, decided
to ring the National Business Register to sort it out, after a few choice words I was told that if I can prove that Ive been using the business name for 5 years + and write them a letter saying how it would be a pain etc to change names then that would be the end of the matter

This seems to be a very grey area with no one really seeming to know whether business names need to be or can be registered unless you go ltd, thankfully when I get round to writing my letter my fiasco is over.
Thanks for your replys on this and especially matt townsend for your very helpful e mail.
regards
