Cant go into any details on here for obvious reasons but will tell full story when I can.

Had an alledged incident a few weeks back which is TOTALLY unfounded and TOTALLY fabricated and thought nowt had come of it however gets a solicitors letter in post yesterday wanting my insurance details so they can pursue a claim - fortunately got public liability.

Will pass onto my insurer tomorrow who I contacted when this alledged incident happend.

Rather angry at the moment and need to know how these things tend to pan out if anyone has been thru this before.

When its over gonna bill this person for my time and costs and take to small claims court if they dont pay as I think this is gonna take up my time and effort for a while yet.

Scumbag solicitors and scumbag clients doing my head in.

So can anyone tell me how these things tend to pan out ?

chances are you will loose your,business,home,divorced and end up in the street ;D..............i will give you 3 x times the value now while you can still sell it...........and thats because im your friend ;D ;D

ps....you can live in my garage and produce water for me in return for food and shelter :-*

I dont think it will be good news mate, they will make a claim regardless of the truth.

Calm down and take a deep breath.  Anger will not help.

Pass it to your insurers.  They will ask a series of bone-headed questions of you.  Answer them calmly; why raise your own blood pressure?

Write back to the solicitor simply stating that the matter's now in the hands of your insurers and that all correspondence must now be between them and the insurer.

Wait. Answer more boneheaded questions.  Stay calm.  It's not personal, it's business.

Either your insurer will pay out or not.  Live with it.

Forget any ideas of suing for wasted time or whatever; you won't win.

STAY CALM.  This is why you pay your liability premiums, so that you don't have to waste any emotional energy on the matter.

 I feel for you fellah- its summat we all fear.  I heard a story from a mate of an unfounded claim,she had to cough for 1500 ,premiums went up but not by much ,she has employees

 totally agree just make sure you have all relevant risk and method statements and proof these where being followed as your insurance will ask for them, the process will probably be dragged out for between 6 to 12 months and unless you have absolute proof the accident didnt occur they will get something plus the scumbag solicitors will make money out of it, we had a bogus claim by an employee we TUPED over on a job fortunately he was so dumb he changed his story numerous times and told numerous lies on the medical we had to pay to send him on so he did not recieve a payout  the downside we still had to pay his wages for about 3 months whilst he was on suspension from work.
  it is easy to say dont let it wind you up but i know it does but as already been said although the situation is unjust at least your insured and let them deal with it
better to remain silent and be thought a fool than to speak out and remove any doubt

Expect to see more of this kind of thing!
If the police can sue people who dial 999 to report a crime then the genie is definitely out of the bottle!!!!!!

not really advice their offering more of how these things tend to go ........ some helpful points thus far such as making sure all H&S paperwork in place .......... which it is.

Insurance companies aren't stupid and will probably send someone round to look at the damage anyway.. if its a load of bull they will probably suss it out.

I had one a few years back saying id soaked there ceiling :s noticed the bathroom was above she acussed me of all sorts saying the wfp had done  it little did she no only about 1 litre is used per window.. she was thinking it was more of a pressure washer  ::)roll .. last thing i heard was she wanted my  insurance details which didn't give her!! and then said she was going to get a building surveyor "who knows what there talking about" apparently to look at the damage.......laffed in her face.. never heard anything again.

We had a employee try to make bogus claim our insurance companies lawyers where all over it like a rash soon got kicked into touch .

You haven't indicated what type of claim they are making. Are they saying you damaged something?
If so it's like going through your car insurance, dont admit to anything and leave it with the insurers.

If it's personal harm I've never had that sort of claim.

When I broke a one off piece of art my insurers said the process was that the householder gad to get it repared or remade and then claim.

hmmm never knew that .......... would have saved a lot of time but prob better having them than not esp now with this going on.

See what their advice is. They won't want to pay out if there is the slightest inconsistency.

It's often good to have a risk assessment anyway, sometimes the Insurance Company like/require one.

a faker will often come undone by grossly exaggerating their injury/s . that bloke who worked for me  a year ago and crashed the van started off claiming " whiplash" but within a day or 2  it had become" paralysed from the eyes down " when he fancied the big money dangled by the claim boys .  if claim firms ring you up be sure to tell them you don't want to talk its ridiculous  ,say nothing more- then they have doubts sown  .
 they knew you cant be paralysed yet still talking on the phone asking when is  my cheque coming etc

SBPF-where did you find out about the RAMS only needing to be for companies employing more than 5 people?
Does than mean sole traders don't need that kind of paperwork?

Because he asked for advice, perhaps.

And the advice I've seen (at least by the time you posted) is very general about how to deal with it.
