Ended up in Hospital today. What would you do?
« on: July 31, 2012, 08:39:17 pm »
Slipped at a custies house in a cluttered passage to the back of her house.I turned around to tell them I cannot clean the windows with all the clutter and I having to climb over things.Slipped on a gym mat and dashed my head on the concrete base. Lay unconscious and woke up wet in the rain and did not know how long.went I got up and could hardly walk and rang the door bell and was told I should have asked for help.
I ended up at A&E ex-rays and whiplash and concussion. Had to stay there for 6 hours.
In that time I got a text cancelling my service.
What you do in a case like this.
Thankless are they not,no compassion.

Well within your rights to claim, the customer should provide a safe place to work.
Had they tripped over your gear and the boot on the other foot-i'll bet my years takings they would claim.
To then cancel by text while your in hospital is scummy and downright spineless.

i would call them up and let them now how awful it is of them to cancel you whilst you're in hospital.  what the hell are they cancelling you for anyway? dont get involved in this suing, blame culture, just give them an angry phone call to let them know they are awful people

I think legally, there is a law that says if you invite people to work on your property, you have to ensure that the property is safe.  That sounds like a common sense law to me.

And google, lots of delivery men sue people for tripping/falling at their premises:

http://www.dailymail.co.uk/news/article-1047270/Tesco-delivery-driver-sues-customer-twisting-ankle-driveway.html

If you have a family to support, if you have bills to pay, if you're out of pocket over this and if you are sure it's the customer's fault and you weren't just a clumsy gimp, give the No win no fee dogs a ring.

I would.

think you might find that they'll say you should have carried out a risk assessment before starting work

It might not be what the OP wants to hear but i'd of thought the same. Sounds like he was going to tell them 'after he's climbed over stuff'  that it wasn't safe. He'd of been better off telling them 'before' he climbed over stuff that it wasn't safe. Best of luck with it.

Did they know what day and time you where coming? Because anywhere i know that accepts responsability for on site contractors makes them sign an "on site" form or equivalent to announce they are their. I just  mention that incase thats the road you wanna go down.

I'll accept the validity of your advice. Asians appear to be experts on UK claims.

And I shall take that as a racist remark.  I would like to ban you, but I think I'll leave that upto the site owner unless a sincere apology is forthcoming.  Maybe I'm a little grumpy knickers?

I also wonder if you would say that to my face?  It's easy to be racist to someone on the other end of a keyboard.

I've reported it to 'the mods', just to be sure.

Do what you think fit. Its easy to do anything behind a keyboard when its your only means of communication with some one, unfortunatley or fortunatley i've no other way of communicating here. If you want to ban me then ban me. You carry on using the term 'coon' when you like. Double standards. Anyway, like i said large amounts of Asian gangs have been found to be abusing these no win no claim lawyers. What you wanna do with the info is up to you. Yes you're grumpy knickers, yes i'll say it to your face. No its not easy to be racist. No i'm not a racist. That enough for you? Oh, and no apology.

Yes, I don't think I was left with much choice to be honest.  I'm sure he'll join back up though, they usually do!
