Sacked an employee last week and i have asked him to return my work wear (boots, trousers, polo-shirts, fleeces)

Total value of about £300 I have been around his house, phoned and text but no reply!!!

He was informed by text that if not returned by today it will be reported as stolen!!

Don't like to do this but is it time to phone the Police!...what would you do!!

Think you'll find this is a civil matter and not a police matter. You gave them to him, thats the reason they're in his possesion.

unless it was in a contract that they were "on loan" i think you will find they belong to him and yes its a civil matter not a police one

Had this a few times whilst working in the force,as you said you gave him the workwear so couldn't be classed as stolen,probably at best if you had a signed agreement stating workwear to be returned maybe a slim chance through county courts but highly unlikely.

not sure on the phoning police, when I laid off a lad I only asked for the parts of the uniform that had my company name back i.e. T shirts, sweatshirts and jackets.

I thought theft was to deny a person the rightfull use of their property. If the ex employee is keeping polemans property then surely that has to be theft?

This is what im thinking!! my company is Ltd and im an employee my self, so surly he is stealing from the company as its work wear given like... personal protective equipment....

Did not think gary would do that. I would proberley keep going to his and keep calling him maybe give him in writing that he has two days to return if not you will get the police round his. If still not returned then call them

I am sure you owe him holiday pay and its in your employment contract about workwear ( or it will be from now on).

I had this done to me last year easier to move on tbh.

To be on the safe side, any equipment/uniform etc which you supply as a loan should be clearly stated as such on a written loan agreement and signed by the employee.  That way there is no conflict, the ownership of the property is established and failing to return it constitutes theft.

if the guy wants to walk around in his uniform then he is sad!!

unless he has your logo on it ..... then its a bonus advertising you.

What suprises me is the amount of money invested in a uniform

my uniform with logos are :

boots £24
trousers £8
t shirt with logo £10
jumper £6
fleece £14

all navy blue.

£62 total...

Thats enough to spend on workwear unless you are in to major brand names, which i am not
