First time? Good worker? No discipline record? Let it go this time.
Mistakes happen and this is quite a common occurence. Make sure he knows though how close he came to being charged for it.
(If he is not so good a worker, only you know how to handle it)
Is it clearly marked in the van, on the van by the fuel cap, on the keyfob that this vehicle is diesel?
If not get it marked up and then issue a memo to all staff, that should this happen again, they will be responsible for related costs of correction and a verbal warning

I believe Halfords sell an aftermarket device to prevent this common problem.

I would agree it is an easy mistake some thing I have done myself - I am wondering did he realise his mistake and hence putting both diesel and petrol in?
Also I would tend to agree with Helen if its the 1st time.

So ... 3 gallons of petrol - 8 gallons of diesel and say 2/3 gallons of diesel left in the tank to start with - unless it's a brand new van I'd chance getting away with it.

i done the same  few months ago done about 15 quids of petrol before i realised then filled it right up with diesel  and topped up the tank regular when it hit half way for the next few weeks

all was ok

Make them pay? How? You wouldn't have a leg to stand on. You're the boss, you're the one liable.

Section 13 of the Employment Rights Act 1996 states that "an employer shall not make a deduction from wages of a worker employed by him unless the deduction is required or authorised by virtue of a statutory provision or the worker has previously signified in writing his agreement or consent to the making of the deduction".

For the future, this might stop any problems - much cheaper than an engine rebuild.
