what would u guys do (helen)

 i lost one of my commercial cleaning jobs due to the job being tendered out.  i have been  cleaning this office for the past 5 yrs.
 the manager of the office has asked me for the number of the cleaner i used.it seems to me that he intends to give it to the new contractor.
 i do a lot of other jobs for this company so dont want to upset this manager .but i dont want to give my cleaner to a competitor.
 bit naughty of this guy i think ?what do you guys think@

I would explain the situation and that "your cleaner" is your cleaner and you have lost the contract, he has lost the cleaner.

I think they have to offer the job to the current cleaner, something to do with tupe, but I could be wrong, better look into it though

 mike thats tupe .and doesnt apply to part time cleaners.or part time employees of any trade.

Tupe applies when a company gets taken over, or a contract gets taken over, full or part time staff!

Just reading up on it and it says part time staff are included. Perhaps you should stick this post in the general cleaning section and not the window cleaning one as you mihght get more informed answers, although I am sure Helen knows her stuff

 surely tupe will apply to all trades then?i dont know.
 
 i recently took over a contract from a company and was told that tupe didnt apply as the employee only worked a couple of hrs a week.
 
 it wouldnt be worth me trainning someone up ,only for another company to win the contract by a pound and then claim my worker?

are you going to keep that cleaner employed elsewhere? if so I can't see why tupe would be involved. Don't know enough about it to be honest though.

I know years ago my dad lost a contract where the office offered the cleaner a price(she was going to go self employed) that was better than she was being paid and less than what my old man was getting, she was due to start on monday morning at 7am when my old man rocked up at 6.45 and removed the vac, mops, brushes and cleaning materials etc all supplied by him ;D she was there at 7am crying about what she was supposed to clean with as he drove away ;D

;D I was with him that day and the director was on the phone as my old man also had the window cleaning contract, he was saying what is she meant to clean with? my dad said not my problem ask the new contractor ;D he got the contract back within a few weeks ;D

 i dont employ the cleaner elsewhere but intend to ,as we know good staff are hard to find so i dont want to give thewm up.

From an employers point of view, I really don't agree with it, but employees do have to be protected.
Of course any "new" business taking over a contract, will have to meet and agree new terms with their new staff. I believe you can't put rate of pay down. There is so much involved you may be just as well to contact ACAS.

I'm not sure, but you may be able to get round it.... If your cleaner really wants to stay with you, they could resign and then you could re-employ them on different terms, as I said I am not sure you can do this, but then who would know.
Again all your cleaners has to do if he/she really wants to stay with you, is tell the new business, that they no longer require a job and give notice to them once the contract is transferred.
If the job has been tendered out, did you not get it because of price?

She can go with you, she does not have to stay on for the new firm, its more to stop the new firm getting rid of her as opposed to them poaching your staff, if you dont have a job for her, without tupe she might have no job. They have to offer her job to her or a similar position but she doesn't have to accept it, thats her choice
