NEED HELP GETTING PAYMENTS
« on: May 04, 2010, 11:30:50 pm »
Hi all

I'm having problems with one of MY ex-contracts where by they still owe me money in the amount of £289.00. I've contacted them loads of times but still they havent paid me - I've now started to send out red letter reminders in a hope that they will pay up - how much extra do I charge for being late and how often?. Do I pass on the debt to the credit agency after the third reminder if so which on should I use.

Any help would be great.

hi all

I've managed to get a debt collecting firm that will recover the debt for me - a company called Daniels Silverman. there web site is www.Danielssilverman.co.uk . you pay £229 for a year but at least theres not going to be any more fees put on top. I thinking of going with these as I havent recieved another  payment for a one off job I did over a month and a half ago.

I have recently signed up with Daniel Silverman as well and have two going through at the moment. The template letters work to jog the payment flow and just having the T&C's on the invoice also helps. This means that you can also claim £40 per invoice and interest on the unpaid invoices. They also work with you if you wish to continue with the customer ie payment plans and you don't have to get involved with the ones you don't as they do it all. Its still early days but I've no complaints so far. We've been going 6 years and this is the first year that we've needed debt collectors

hi

we're going to see what kind of response we get from the first rminder then if we still get nothing then we are going to pass it onto the debt collectors. Its the first time we've got something like this as all our customers normally pay up.

Every firm sends the stiff leather coat brigade at some stage but it goes to court as a last result. Even the courts result to this when the fines are not paid on civil matters ie parking fines etc

My personal preference is to use solicitors, we used one last year to recover total of £25k from Developer (who in turn were suing the Managing Agent) for 4 sites - total charges were quite high as they charge for every letter and every phone call - total bill for the £25k was just over £1000 (it was very complicated as agent had given us instruction but on behalf of developer/RMC).  Obviously the less complicated the smaller the charges - the company we use specialise on service charge/ managing agent stuff so knew what was involved.

That may well have been the right course for your case but I have one going through for £288 and one for £78 and any future debts will cost no extra unless they go to court which I think costs £95 of which all but £15 is recoverable. You can ring up and ask advice and they are keen to help as thats how they earn, they will also help out with payment plans if you wish so they don't go to court. Just having the terms on the invoices has been worth the fee

The only reason that I'm thinking of get these peolpe is because I'm sick of big companies taking the pee by not paying us small companies, we have bills to pay as much as them. To take both companies to a small claims court would be pointless, at lease with these people you pay a one off fee and they'll get your money off the client one way or another. So what if it costs them more money than what they owe you but they should pay up on time.I'm willing to pay the £200 odd one off fee so if any more problems arise I can get the big boys in to get my money back.
