can anyone tell me if their is anything legal to stop past or present employees undercutting and taking work

Putting a line in their contract "should you leave, you agree to not contact any**** custonmers, with the intent to glean business away from *****.......this may deter some, but at the end of the day, it is the customers choice! Why are you not sure about someone then?

there is a rumour that he wants to set up his own buisness and undercut myself.has this happend to anyone else and how have you delt with it.

If you worry about him taking work and there is rumour he want to start his own buisness. Then you should have a contract with him like helen said.

But is it worth it?

What contract going to stop him nicking your work if the custonmers drop you.

If you don't know the person that well don't bother. Unless he your good mate.

I had a contract like that when I worked for someone, stated 2 years before i could approach his customers,
Guess you can write in whatever you want, how legal it is could'nt answer.
I never have undercut him or pinched his customers, I'm not that kinda bloke or felt the need to

Because of the time lapsed I would strongly suggest you run anything by your own solicitors but the guys here came up with some good replies.

As a year has past by since your initial post, how did this issue turn out with regard to your employee?

Thankfully very little Spruce 

He attempted to diss our wfp system and managed to get a few odd accounts and one smallcommercial account.  However we couldnot  prove he had targetted them because of his acquitred knowledge as he included them in his canvassing campaign.

He has since lost this account  to another company. 

The employee concerned left w/c after a further 4 months and is now working in a large call centre  !!

The clause is still in our Contract of Employment.

A few years ago i had 2 bright sparks leave me to work for themselves , they had no car between them ( or licence etc ) , milk crate instead of  A frame ladder , they somehow lasted a couple of months with very little work , they did canvass some of mine but i dont remember them getting any of them. I know for a fact that one of them was basically out of work for a couple of years after that .....because he told me when he phoned apologising and almost begging for a job at his previous rate of pay or less ! Of course i said no !!         

One problem i had once was , when i went on holiday a few years ago a newish guy went and collected about £250 for himself and dissapeared , obviously i couldnt recharge the customers as they were just paying for work they had already had , and the police were absolutely useless , saying each of these individual customers could try and sue him in court for each fraud !!!
