Not really a hassle Craig, just time consuming, however this day and age the Judges know that court is the only way that the tenant gets justice, and they usually go out of their way to preach the law to the landlords, this is quite amusing to see sometimes.  The whole judicial system can take up to 6 months, which is a long time if you need the deposit to move somewhere else, so in that respect yes a real hassle, but the winner in court is awarded travel costs, court costs (not the opponents solicitors bill in a small claim court) and days pay, last landlord I took to court in October was from me moving out in June, I was awarded the whole deposit, and £275 costs. Only just got the money last week though.

By the way : If landlords dont do the deposit scheme or do the insurance and can prove it was done, the tenant can be awarded up to 5 times the deposit as compensation at the judges discretion. I found this out recently when I got involved doing a clean for a magistrates son who was getting hassle from his lanlord.

This alas is not true, just last year the court of apeal ruled that you have to still be in the property to have any chance of claiming the fine of 3 times the deposit, but not the actual deposit itself, as that can only be returned when you leave the property. However the tenant has to claim for the none deposit and not being informed of the deposit scheme, BUT as I put in my earlier post, to combat this all the landlord has to do is put the deposit in a scheme the day before a court hearing. The law is being changed this April, but still not enough. If a landlord has not protected the deposit the only benefit to a tenant is that he/she cannot issue a section 21 notice of intention to seek posession.

Mark i dont suppose you know this landlords name do you as i certainly would like to be pre warned about him so i dont do any work for him.Sounds like a wrong un on the make intimidating young people into handing over cash(seen too many and try to avoid).I saw you the other week at the petrol station but i am not sure you recognised me with my silly tash on(gone now).Regards Alan(swindon)
