Good Afternoon.
Below is a copy of the e-mail sent to the company that sold us 4 Aluminium Poles, today i spoke with what they term as our account manager who stated that the poles were being returned to us by Thursday, they have not replied to our e-mail below. We have now sent a further e-mail today which we will post shortly. Which contains details of another window cleaning operator who has similar problems with the same poles at the same time December2009 to March2010.Due to the totally unacceptable way we have been treated as a customer it is our intention to fight this problem all the way, we have never been involved with something as blatantly unfair as this selective warranty and we beleive that this is not an isolated case so if there are any other window cleaners out there who have experienced similar situations help us to confront this behaviour head on and maybe we the window cleaners can get some fair treatmewnt from the unjust god like manner of the manufacturers who will gladly take your money but choose to ignore you when you have a genuine complaint. This is no longer just about the warranty on the poles this is about getting fair treatment as a once loyal regular customer, and if we acheive some kind of result then we as end users of these products all win.
Further to our conversation on Friday 22nd of October 2010.
We totally refute all accusations of misuse of poles purchased from xxxxxx, it is our belief that the problems lies with a faulty product therefore under The Sale of Goods Act ( 1979) we request a full refund of monies charged for the products or a full repair.
The rational behind our request is simple the products sold by xxxxx are not fit for purpose and in supplying the afore mentioned sub standard products there is a breach of contract namely The Sale Of Goods Act .
We are not been unreasonable; if you sell a product with a 3 year warranty then it should be a 3 year warranty.
We operate 10 vehicles kitted out with numerous poles of all sizes and designs we have never had this problem.
The poles in question have been used in 4 different vans by 4 different cleaning teams each team operates with a minimum of 9 poles in each van no other poles have bent so the common denominator must be the poles supplied by Brodex.
If we cannot reach a conclusion to this problem then send back the poles I will send them away for analysis, we will then issue court proceedings through the small claims court.
I look forward to your earliest response
