'False Self-Employment’
« on: September 01, 2009, 03:54:52 pm »
This was written regarding the construction industry but I'm sure it will involve other industries including WC.

‘FALSE SELF-EMPLOYMENT’ IN THE CONSTRUCTION INDUSTRY
The government has been looking at the best way to address the issue of what they believe is ‘false self-employment’ in the construction industry. They have concluded, for income tax and national insurance purposes, that they will introduce legislation which deems workers within the construction industry to be in receipt of employment income unless one of three simple, clear and easy to apply criteria is met.  These criteria take the form of three questions which ask whether the worker provides:

•   their own equipment (other than customary to the trade)
•   their own materials
•   additional workers to complete the job.

The worker will have to satisfy at least one of these criteria to be regarded as self-employed.

The government are consulting on this issue at the moment.

its allways been a pain for the goverment

when working in the building game, i could earn 200 quid a week more by just being SE'ed

i owned all my own kit, allways have

BUT its easy to get around them criteria's

•   their own equipment (other than customary to the trade)

company that employs said SE person buys a basic kit ( or insists the person does ) ( hammer, saw, pliers ) and give them to the worker ( the cost will be less than 20 quid )

they then have the kit

It's all changed since then. The government came up with a scheme to get more taxes. It's known as the Construction Industry Scheme (CIS).

If you do any work for a building company or contractor you have to be CIS registered.

What ever work you do including window cleaning, generally the taxman will take 20% on the payments you receive for labour and it's the company who pay you who deduct the money.

It's almost impossible to now work in the construction industry as an individual and avoid the CIS tax deduction.

I did a job where my profit was 13%. I could have cried. I now have to wait untill the end of my tax year to claim my profit back from the taxman.

Just chant..... Hare Krsna, Hare Krsna, Krsna Krsna, Hare Hare, Hare Rama, Hare Rama, Rama Rama, Hare Hare. It's beats chanting Tory Tory or Labour Labour.

they take 20 % off you, thats correct, BUT as they dont pay NI etc etc, they will still pay you more

i have a CIS card, it followed the 715 card if i remember correctly

it was the same with the 715 card, it was just a saving scheme, as you saw a fair % of that tax back at the end of the year

I think those cards are now out of date or at least my old CIS 4 registration card is. The company I did work for a few months back weren't interested in it. Then their accounts dept phoned me up to check my details. It turned out I hadn't registered for the new scheme so I had to register again.

It's now done by NI number and UTR.

715 card? You're showing your age.

Are you still playing with that garden brush and hose pipe claiming to be a window cleaner?  ;D

Yup - that's me. Like you I've been registered on here for yonks. I  used to work with a couple of others and our main vehicle was a hearse. That ended with a diasterous conclusion.

About 2 years ago I moved from where I used to live in Brighton to London and ended up driving 800 mile a week as most of my work was still in Brighton. Most evenings by the time I got home I was a jibbering brain dead wreck having endured the M25, the A2 and the Blackwall Tunnel twice a day.

I still looked at CUI but to post anything would have read like I was a demented madman.

I'm surprised you remember me?

Now I'm back in Brighton so life is so e-a-s-y.

Cheers

Cheers for that.

Especially from a man who enjoys taking his daughter on a roller coaster to scare her half to death, but then who takes great delight in videoing her torment.  ;D

3 years? Has it really been that long? I was young then and able to carry a 35ft three extention ladder on one arm and an 8ft pointer plus bucket plus jet spray on the other.

Anyway, enough of the twaddle, this is a serious wfp forum.

Cheers

Yeah. That cake. I remember that cake with gritted teeth. Along with many other disasters. I wonder that my missus is still with me considering my frequent disasters.

My last disaster 2 nights ago was to plunge the kitchen sink just as my lady came into the kitchen. She was on her way out and was all scrubbed up in her best togs. She'd just came to say good-by.

I didn't know that the water would shoot out the over flow.

Some people are just born to be constant walking disaster area's.
