contract for buying a round.
« on: June 20, 2013, 07:19:53 pm »
I have a well established round in my area and I am just about to buy a considerable amount of work established 25 years from another windy i have known since I started. All his customers know he is retiring and he's told everyone he has found a replacement for them -- Me!

Any way he is being gracious enough to take a third as a down payment and the rest is to be worked and paid for over the coming few months.

Does anyone have a contract I can use to protect myself so i can sign it with him and with independent witnesses to cover I disagree?

Many thanks.

A contract is simply a document which sets down in writing what you have agreed verbally between you. You should start by writing down exactly what you think are the terms that you have agreed - both from your side and from his. You might want to get down how much you are paying, how much deposit, how much per week/month; I would also include an appendix of all the addresses. you might want  think about what happens if things go wrong - such as non payment or if he starts to approach the custies afterwards; you may also want to think about clauses which prevent him from selling the round to others.

if you want I could help if you want to send me a list of the terms you want to include

Cheers, Tom

call me old fashioned (or naieve) but all of my buying and sellling been done on a handshake.

the fact he is letting you pay over time shows trust and if it was me giving you time to pay i may be a little saddened that you would ask me to sign a contract ??

of course you want to be introduced to every customer before money handed over

Sounds like you have got a good deal, if you start talking about contracts you may upset the seller, and lose the round.
