Not wanting to be a party pooper here but getting a customer to sign a disclaimer to say that if you scratch a window its not your fault will not prevent them from legally being able to make a claim against you.  If you are legally liable, you are liable.  Having a document to say they agreed you weren't would be binned by a court.

Forgive me if my undertanding of your request is wrong.

Well yes mark you are a party pooper  :'( ;D That is exactly waht i wanted mate....the only reason is iv been told to never do a builders clean without one and iv put a decent quote in for a clean and its been accepted!

Well, what you want to do in such a case is to get the site foreman to go around and look at all the windows with you before you start as there is very likely to be dirt and grit on them.  They will almost certainly blame you even if there are scratches already present.

So there are two different issues here.   A disclaimer cant negate liability where there has been negligence but it can help when there hasnt been any.  If you do an inventory of any existing scratches and get him to sign to say he can see them then he takes responsibility.  Like a car hire company does before you drive a car away.  That way, he knows about them and has agreed they already exist.

I have heard of so many cases its unbelievable where the windows were scratched in transportation or storage or by the glazier but were never spotted until they were cleaned.

trouble is mark you can't see some scratches until the window is cleaned, so going around and checking is no guarantee, and fabricating debris can cause scratches through no fault of the window cleaner, I think this is what he is after, of course is someone uses a blunt scraper and scratches a window then they are at fault disclaimer or not.

A scratched glass waiver will also cover you for 'Fabrication Debris' which is a cause of much of the scratched glass on heat tempered glass.

Even with good practice scratches will appear due to the poor workmanship of the glass.

I would also take out an insurance which covers glass being worked on as IMO the reason most omit this is because of scratching the glass as opposed to putting your ladder through the window.

mark I am only half way through my current policy but would like to change, as the cover isn't great and I am now doing a lot more commercial. is it advisable to change mid way through a policy.
