To whom it may concern,
I have been made aware of a post made by you on 23/12/2013 on the Tiling website forum
I would like to take this opportunity to defend myself as I strongly feel this post is completely untrue, inaccurate and defamatory. I also argue that your statements meet the requirements of defamation as set out (Parmiter v Coupland [1840]) and are therefore in breach of the Defamation Act 1996.
I would like to take this opportunity to point out that;
• To date I have not worked at Somerset House.
• I cannot see how I could “cock up” any floor at Somerset House when I have not ever worked at Somerset House.
• You referred to photographs and the quality of the work shown in them, but you have not posted them. Again, if this was true you would post them.
• You also mentioned an “American Chemical Method” being used and causing considerable damage. Again, where is the evidence of this? And how can this method cause damage? How can you be 100% certain that, there was not a third party or other external influence causing the damage? Again, how can you say that I caused the damage when I have not worked at Somerset House.
• My work has always been of the very highest standard and my customer feedback has always been highly positive. I regard your attack as a deliberate and highly juvenile attempt to damage my company’s reputation and to steal business away from me.
It has also come to my attention that you have already been removed from a similar website for making similar defamatory statements. I would argue that the website host is also liable under the guidelines set out in (Blunt v Tillet [2007]) for not moderating a clearly defamatory post and not taking any action towards the author of the post (you);
I would expect you to stop all malicious communications regarding my work. Any further acquistation will be met with legal action. I will give you 5 working days to remove all posts, from all websites I also expect a formal apology, as I fear that my reputation has been damaged. Any failure to do this will be met with legal action which would result in an injunction and significant damages to you.
