Hi all,
Just thought of a question that I'm not of the answer to . .. . now doesn't that sound big-headed!! :P
Question is .... when an office cleaning contract is up for renewal, and the customer takes the opportunity to get in new quotes, would TUPE come into play if they took up the offer from another supplier?
I would think not, but you can never tell with things like this!

Oh YES indeed!
TUPE comes in to play and you have to take the existing staff on!
They can opt out and if they opt out you can then employ your own staff.

See, that sounds odd to me, if there is an agreed point where the contract effectively ends.
But I've learned not to second guess government legislation!

Its a service that is being provided. Peoples jobs are a stake.
The only way out is OTE REASON company organisation, Technical Economic reason.
