Two yearsagoI switched from Talk Talk to XLN Telecom
On Thursday I decided Switch Back to Talk Talk as I can now have Free Broadband
On Saturday I get a letter from XLN Telecom demanding a £220 cancellation Fee
When I switched from Talk Talk no Cancellation Fee same with BT
When I joined XLN I was told I would have to remain for 18 months this i did
it was repeated to me twice as part of their Code of Conduct
No Mention of Cancelation Fees.
Some clever Solicitor or Con Merchant has hidden the Clause somewhere.
Obviously I will be going to Offcom
Where i think they got me is they switched me from a private number to a Business so I have probably lost my consumer protection rights.
So Beware
looks like I will have to stay as fighting it will take ages
Meanwhile I will post all over the internet as i know this and other sights get picked up on Google.

i get umpteen calls a week asking me to switch my phone and mobile and broadband, we can save you this, we can save you that.
i say "no thanks, i'm happy paying a little bit more to BT, there a trusted name and well regulated, and my deal with orange for mobile and braodband is unbeatable"
they still try but its there waste of time not mine.
yes BT are dearer but you know where you stand with them.
just my thoughts.
as we all keep saying, pay cheap pay twice, shauns words if i recall.

I stay with bt because I have phone permanantly on divert 24/7.
Have swapped to other companies in the past only to find out you calnt get caller display on divert with them,most annoying when you loose reception and calnt ring them back.
Also the divert delay is longer and sometimes people would put the phone down just as it rang my end because they thought it hadnt gone through .
I dont mind paying a bit more without the hassle ;)

Am with bt and as otheres say its a bit more i rather pay it and have lots of backup if anything goes wrong :)

They switched you without your consent? Or did you request it new contract methinks ;)
Had a contract with Orange upgraded phones 11mths later decided cancel unbeknown to me contract 18mths. :o >:(

I was with BT but changed to Tesco 6 months ago, i kept number, call divert is the same, you get caller display and the calls are far cheaper and the line is still owned by BT so you still have the same backup. Our bill is now £50 a month was £100 with BT

I Switched to XLN on the understanding it was an 18 months contract.
I did not record the call for training and monitoring purposes ;D ;D ;D
I do remember the Salesman going over what I had agreed twicel

Ask for the tape of your call.
No tape-no contract.
Whilst you may be estopped (this is a particular way of forming a contract) from denying there was a contract you will have equal power to say that there was no penalty ever mentioned in your oral dealing s with this company.

I was planning to send their Head of Customer Service a recorded delivery letter.
Regarding What i thought i had agreed to etc.
my problem is do I stay with them
Or do I cancel talk talk and fight in small claims court if i have to etc
What I need to watch is that XLN do not cut me off. as my phone is the lifeblood of all my small enterprises

Just to let you allknow they dropped the disconnection charge.
Still fighting Lloyds bank over their Premier Card If you have a home emergencey claim phone within 24hrs I gavea honest answer with my hot water not working and they refused to come and repair it because I said it had not been working for 3days. After all I was carrying out tests and had not read 24hr clause on page 82
think Ive got to take on British Gas they appeared to have locked me into another fix price deal with a small clause if you do not phone us we will lock you in to this price until 2010 Fine but I believe prices are being cut in March 2009
