sorry its off subject just wondering if any of you have any experience, im having a bit of a dispute at the moment with my landlord im due to move out at end of the month on xmas nite the house was broke into causing considerable damage to the locking system on the upvc french doors. she is saying i should pay for the repairs where as i think she should as its part of the fixtures and fittings which she could claim for on her home insurance.
does anyone know where i stand????
any feedback would be greatly appreciated (please mods keep this on for a bit its very important)

I would say it is the owner of the property, and should be claimed on thier insurance, call citizen advice they should be able to give you the correct answers as I am just saying what I think

As the landlord she should have Landlords Buildings Insurance in place which also covers any fixtures and fittings as well as any contents that are left in place, which in this case is irrelevant as any external doors would be covered under a standard buildings insurance policy.
This is in no way your responsibility and if I was you and was feeling very generous I would offer to pay half of the policy excess at most.
I hope you have a crime number for this - as I can see her trying to withhold it from your deposit.

the sad thing is, even though the landlord is trying it on ( and she is ) she will have your bond, so she has the lead
tell her to claim on her LL insurance

cheers guys for all the help ive tried ringing citizens advice but its either engaged or just rings n rings haha i have phoned round a few letting agents and the general feedback is that its down to the landlord to deal with her insurance as i have crime ref number.
fao alistar its a chap called simon davies he runs a web design company in chester called roodee web design or something just google it.im working with him again on a different project with my friend which is an advertising website for car dealers. Its still not fully completed iv got images of my own to upload etc just waiting for simon to finish some big projects

I got screwed by landlord on my last rented home, door fell off one day and smashed on floor, they made me lose my deposit for it despite having witnesses see it fall off the rail and land on the ground!!!
I hate rentals!!

landlords are all the same. when i was unfortunate enough to have to rent i had about 2 verbal fights (nearly fistycuffs) to get my cash back. in the end the last 2 houses i rented i would always not pay the last months rent and tell them to keep the deposit. there all the same and will try to screw you.
as for your problem richy they should have some sort of insurance surely!!

Mine was through an agent not landlord :( so couldnt even bully for it.

i had one through an agent and told him i would be there in 10 minutes for my cheque. he said that the owners may chase me i said they could do what they wanted i'm coming to get my cheque. that was that. if they can keep hold of it they will. i think its like their slush fund

Go and see them in person, much better. If you LL or LA insists you pay or withhold your bond, fight them with the backing of the CAB. Whoever it is wont want to be paying court costs..lol
However... ensure there is nothing at all wrong with the rest of the property, as they will get you on that one. even if its a mark on the paintwork.. whoops have to repaint the whole room..
Myself and my ini housemates took the LL to court, regarding this.. we won ;) They claimed they had done work.. we went round took photos with the new tenants permission.. and had proof nothing had been done.
Sneaky fookers LA and LL.

deffinately landlords responsibillity.anything you are liable for will be in your tennancy agreament.

Right i be honest the chances are she has insurance for tennents damage (flooding fire). And a standard home insurance policy which covers her for fire and flood and subsidence. You will find if it goes to court as you were residing there it and the break in happened while you where renting the property the damage is down to you.

Starting from the top .....
1. If you had an attempted break-in you would have reported it to the police and will have a crime number - correct?
2. You reported it to your managing agent/letting agent/landlord at the same time - correct?
3. Your deposit is held via the Tenancy Deposit Scheme - correct?
4. The damage is to the lock only - correct?
5. You reported missing items from the home (your personal belongings) to the police and have a crime number - correct?
Let me know the answers to these questions and I'll tell you the likely outcome.

WRONG.
Locks/doors/windows are part of the fabric of the building. These should be covered and insured by the landlord.....juts like if the roof caved in!!!
BUT....you have to meet certain requirements. Tenants have duties as do landlords.
If tenants fail to meet their requirements, then it is considered an uninsurable risk and the tenants fault.

Why don't you ,if you don't have it yourself under some policy, membership, FSB etc etc, find a mate who has free legal advice and ring a lawyer and find out from the horse's mouth. With the greatest respect window cleaners are not lawyers. I am sure lawyers are not very good at cleaning windows.

And believe me, Tenants are not all faultless, I went to clean out one of my mother-in-laws a few months ago when they did a bunk, I found a cannabis farm in the loft (all gone :() and the kitchen was full of dog crap, chewed cupboards etc. and it was not an isolated incident.
but as for the original post, Good luck, I think you are in the right, but that don't mean it will be easy if they hold it back.

And believe me, Tenants are not all faultless, I went to clean out one of my mother-in-laws a few months ago when they did a bunk, I found a cannabis farm in the loft (all gone :() and the kitchen was full of dog crap, chewed cupboards etc. and it was not an isolated incident.

How can u generalise like that. All landlords are bad, the same as saying all germans are nazis, all blacks are muggers, all Geordies are drunks, all Scottish are tossers. I window clean for a company I do 20 houses (10 each month). I get paid on time, all the inmates ;D , seem happy. Mind u I like the Welsh and the Cornish hahahaha.. I was born in Truro and am a celt

haha its gettin quite entertaining this post luckily i disturbed the theieving toerags n never had anything stolen except my mates 20quid torch!!! they even left 2 cds which the police never got prints off.the general feedback iv had is that she should pay for the damages iv spoke to 3 different letting agencies n the all said she should claim on her insurance,also had a question answered on ask jeeves by an american lawyer he said basically the same.

I have a few houses that I let and it is definitely the landlords problem on one condition - that the break-in was reported to the police and they have noted the break-in.
If you did this then the landlord has no option but to pay for it herself or claim off her Landlords Insurance. I have mulit-tenancy insurance which covers all this and by rights she should have insurance too.
I would get in touch with her and explain this, if you get no success this way then send her a solicitors letter explaining the situation and demanding your deposit back.
