Some of you may have noticed a hybrid pole for sale on eBay (Item number: 260236960943). This is, we believe, one of our poles which we are in the middle of reclaiming from a customer who has not paid for it despite numerous calls/emails/etc since October 2007. You can imagine our surprise to see it turn up on eBay! Because the customer lives in Scotland there are different procedures we have to go through, but it is in the hands of an agency who are bringing a civil court action on our behalf. The seller on eBay has been notified and the police are aware of the situation. We don't want any of you guys ending up with a pole that gets reclaimed by bailiffs.

We believe this is the original pole we sent to our client in October. He emailed to say he didn't want one with a grey base section (not as politely as that), did we have any with a red base section. We did, so we couriered another pole to him the next day with the courier instructed to pick up the original pole. Unfortunately whilst he accepted delivery of the replacement pole, he refused to let the courier have the original. We have been chasing this ever since and a few weeks ago decided to use a debt collecting agency to take this to the next level. Unfortunately for him, the next step is bailiffs which will end up costing him a lot more than the price of the pole by the time court fees, bailiffs fees and the agencies fees have been factored in.

I'm shocked to think that he reckons the pole belongs to him!
Good man Alex, send the bailiffs in - just wait and see if he tries to stop them!!

are you going to bid on it and collect it without paying or get some bailifs to do it for you? dont want it to end up somewhere else if someone else wins the auction.

If you report to ebay they will remove straight away, there very quick as i had someone put a mobile on my selling page that didnt belong to me and i contacted ebay and they removed it.

Ask a question and see if he puts it on his page, Are you intending on paying back gardiners with the money you recieve from the sale.

Go to the listing and at the bottom of the page you can report item, if we all do that the pole wont be on ebay for long ;D

I said I liked the pole. I was surprised that he was selling a new pole as he had not sold anything on ebay. (Feedback 16 all from buying)

It is the same small town. I think that he thinks he has waited it out for long enough.
Thanks for all the support, we do have a very good team on this who are about to start court proceedings, which we have been assured of getting in our favour. This will end up costing the client an awful lot more than the cost of a pole. You can ignore letters and the phone, but when a bailiff knocks with a Sheriff's ruling, you cannot ignore that.
I just wanted to post this so that no one else got caught up in the problem inadvertently.

That person might end up with a bargain or once the Sheriff is involved, they might have it taken back from them and be out of pocket for that amount. It's incredibly frustrating watching this but because the legal procedure has to cross the border, it takes more time. I was hoping this would be sorted before the end of auction so it wouldn't be so messy and drag an innocent buyer into it. Aaaargh.

why not contact buyer through ebay and warn them ?

You are not able to do this with this particular listing as it's been set up with the bidders being anonymous.
We've probably all heard of a case where someone gets a friend to bid on an item to push the price up and they end up being the highest bidder. Who knows what might happen.

why not 2 biders bid 100 000 each then it wouldnt go to a unsuspecting customer

Because, if you bid on eBay and fail to pay you are in breach of contract regardless as to the validity of the listing. Obviously if a mate wins it by accident, you can ignore the transaction and no-one's the wiser.
I notice that payment is through Paypal only so if an unsuspecting buyer does get caught, Paypal will reimburse them but that obviously isn't ideal.
I have let eBay know the situation so they have it on record and hopefully will be able to help an innocent buyer if required.

No offense mr tumble but I think you are getting too involved.
I'm sure alex is in the right, but to be honest WE JUST DONT KNOW, do we? There are two sides to every story he might have had (what he feels) is a genuine reason for doing what he did.
How do you know, for example, that alex didnt con him? That HE might be the one who has been ripped off (I'm not suggesting that you did alex matey, just pointing out that we dont know) OR it might be a simple misunderstanding.
The point is, only those involved know whats really going on. You being a vigilante and trying to track down his address is going too far. Alex already knows his address and is dealing with it through the proper channels.

I tried it the other night (y'know, warm, sunny/sultry even).
I couldn't swallow the slime personally... I prefer shellfish well done, chewy, not snotty.
I'd try it if it were done by an 'expert', but you never know if the Frenchman doing the cooking has a grudge against the English as so many Brists seem to have against the French! :-\
I ate sardines, bread and garlic butter done on a town plage a few years back, à la native and it was gorgeous. I daren't imagaine what I might have been given if I'd gone in there with the Union Jack wrapped around my shoulders. ;D

The pole has been taken off of Ebay,he`s either sold it before end of auction or he`s got worried.

Interesting this one. If I got if off him there is no chance I would let the bailiffs have it if they came knocking. How can anyone prove that the pole he is selling is the one you sold him and indeed the pole he has not paid for? Are they coded? I hope you get your money back but even if you get the pole it is now secondhand so you will want more than just the pole I assume?
