Title: disgruntled employee wants to report me to trading standards

Hi Everyone

I have had a laugh today, One of our cleaners are leaving, and she asked me what holidays she is entitled to,  Obviously its on pro rata and accumulates through the holiday year. This was before i knew she was leaving, so i told her the amount to end of her holiday year.

She then hands in her notice and still expects to get the same holidays that she should have had if she stayed til end of holiday year. it was 6 days left, but i had to recalulate and its now 4 hours !

She so isnt happy, and has told my staff that shes taking this matter further and complaining to TRADING STANDARDS.

Now, call me daft if you will, but i thought trading standards dealt with consumer regulations, not employment laws.

She is also complaining about i dont pay the right amount of mileage and that for her 1.7 or whatever engine she should receive 42p per mile or something. She is completely unaware that she needs to fill on a p87 to get tax relief for the bit of mileage i dont pay, and i cant get an year ending 2008 form yet to give her. I think im quite generous paying 20p per mile plus passenger rates aswell. Even if its not compulsory.

I feel like laughing in her face cos its so rediculous, but here she is having me doubt myself. I'm 99% sure im in the right here, but what would you guys do in my situation?

She may be right about petrol, I have no idea on that side but if she goes to any organisation (I think you're right, its not trading standards she would go to) and complains about holiday she will not get  any further and may possibly be laughed at! Did the cleaner give you the chance to explain why she was getting less?

To be on the safe side I'd advise you to call the FSB if you are a member (if not you shoud consider joining) or possibly somewhere like the CAB?

Lisa, does she have a signed contract stipulating her holiday entitlements? by law she must have these details within her contract of employement, as long as she has it in writng how her holiday pay is calculated(including if she leaves) then alls ok.

contract states all holiday payments are accummulated pro rata Chris.

I think she is just kicking up a fuss cos she is leaving.

trading standards deal with customer/trader issues dont they ?
If so, she needs a dumb vaccine.

thank the lord for that! employee has now left

i gave her acas number incase trading standards laughed at her.

on an even more positive note, started 2 new staff today all signed up ready to go for monday.  ;D

she was peeved off cos she thought she was dropping us in the doodah with lack of staff, already had 2 ready waiting in the wings.

fingers crossed, these 2 bring a better working atmosphere with them. They are raring to go at the moment, i'll see how they feel next friday.  ;D
