Title: notice to leave and hol pay

Hi

Just wondered if anyone knew about this.

cleaner wants to use her holiday leave (6 days) as notice period. (notice i have to have is 1 week).

Is this ok to do?

Hi Lisa,
Normal company rules would say an employee has to request holidays with 4 weeks notice (to allow you time to make arrangements) but it depends what was in your contract of employment. At the end of the day it is up to you really. iIf the employee walks without notice you still have to pay holiday pay. Hope this helps,

hi,

Company rules are 4 weeks notice to have hol leave. she prob doesnt think this rule applies to her  ::)

we'll see what happens, ive been sent a letter from someone she has applied to and they said "thank you for agreeing to provide a reference, please complete this form" although i knew nothing about this, i wasnt even asked.

i know now why she has been shady with me all week.

Do companies send out reference requests when the person has been offered the job? or before an offer? ive never really been sure, i request when they have just started and say continuation of employment is depending on satisfactory references

It sounds as though she has been 'offered' the job, 'subject to a favourable reference from you.'

She has not really been dishonest with you. Not many employees would tell their employer that they are looking for another job. So I wouldn't hold that against her.

No matter what, she is going to leave you, so it would be better for everyone concerned to make things as smooth as possible. Write her a favourable reference.

You will have to pay her any holiday entitlement she is due anyway. So unless you need her really badly next week, you might as well let her take them as her notice period. There is nothing illegal in doing this, but I would advise getting her to sign something to say she requested it and you agreed.

if a cleaner wanted to leave I would rather let them go asap, nothing worse than a disgruntled cleaner working with others.

Like Lesley I would let her go asap. Nothing worse than an employee you know is going to go causing you probs before they go,
