Title: is Alex going to Sue Unger?

Just had a quick look on gardiners web site and he has a patent on his shop page.

I'm just wondering about this bit
"telescopic nesting combined with modular extension sections"
as unger did that with their nlite. so did that asssie with the reach-it..

Not a chance, there are many ways to skin a cat. Most patents are for vanity sake and have no real authority in the real world. You only have to show the application of a patent in a different pre existing application to void it. There is a lot of wasted money on patents which are worthless.

I heard if you alter a product in 7 ways, no matter how small the changes the patent is useless. Not sure if its true just going off what i got told :)

Theres a big difference between a utility patent and design patent.
A design patent only covers the look of it.
A utility patent is much more strict, if you have a utility patent it covers the concept not look of it.
So alex is safe with his patent.
Depends if you have enough money to take someone to court, and i know alex Has.
Dont think he needs to though has i think Alex wins when it comes to waterfed pole equipment.

What is the point of having a patent if you're not prepared to protect it?

So you can say "look look we have patented this, so please buy it!  You can't get it anywhere else cos we have patented it!! buy it buy it quick" and so people do.

Then when it comes down to the nitty gritty and the so-called patent is either too difficult or expensive to defend.  That's when people realise your "patent" isn't worth anything.

I remember gardner website saying their "lateral clamps" were patented blah blah, now everyone does em.  Either the patent would not stand up if challenged or gardner can't afford to defend them.  Either way its pointless.

I've heard Sue Unger is hot!  Maybe he should run off with her.
