Title: Employing - self employed.

Just wondering if any of you guys that employ take on any self-employed individuals and how that works regarding tax. My accountant has suggested that employing self-employed isn't necessarily kosher so far as the tax office is concerned. I'd like to do so 2 days a week; some weeks 3 days, some none and done 1 day, depending on workload.

What do others think on this?

Isnt that sub contracting?

Surely theres nothing wrong with employing someone whos self employed anyway?
But remember employing someone comes with responsibilities, holidays, insurance, equipment, fuel etc etc
Then you have the extra admin side of things

is he referring to cscs card were you deduct the ni/tax at source

cant see a problem with employing self employed as long as he is able to show he works for other people/companies
ie ..his not just employed by you because then technically he is employed by you and should be treated as an employed person

He does do other work Bob, window cleaning and painting and decorating too.

Nothing to do with CSCS, thats building trade isn't it?

Google self employed and see if  you can comply, your accountant  is right. I don`t  you  think it can work, regally. if your worker get upset with you and finds out this is illegal he can ask you to pay all the NI and commitments you have not paid.

as long as the 'self-employed' person is free to do other work or run their own biz then all you need is an invoice
from them for services tendered.

it is a greyish area but on the HMRC website are several questions you can answer as to whether or not they
are self employed  like - are they working set hours/days...  can they refuse to work if they wish etc...

probably right regards cscs
as smudger says and what i was hinting at if he works for others and you have a flexible approach to his hours etc then his self employed and a invoice will do
