Slipped at a custies house in a cluttered passage to the back of her house.I turned around to tell them I cannot clean the windows with all the clutter and I having to climb over things.Slipped on a gym mat and dashed my head on the concrete base. Lay unconscious and woke up wet in the rain and did not know how long.went I got up and could hardly walk and rang the door bell and was told I should have asked for help.
I ended up at A&E ex-rays and whiplash and concussion. Had to stay there for 6 hours.
In that time I got a text cancelling my service.
What you do in a case like this.
Thankless are they not,no compassion.

thats really inconsiderate of them better off without scum like that on ya round ya prob wud have a case for a claim yet id wipe me hands with it and thank yaself ya walked away with cuts n bruises

Well within your rights to claim,the customer should provide a safe place to work.
Had they tripped over your gear and the boot on the other foot-i'll bet my years takings they would claim.
To then cancel by text while your in hospital is scummy and downright spineless.

Whatever you decide I'd take some pics of the junk and clutter just in case the evidence gets conveniently cleaned up :)

i would call them up and let them now how awful it is of them to cancel you whilst you're in hospital. what the hell are they cancelling you for anyway? dont get involved in this suing, blame culture, just give them an angry phone call to let them know they are awful people

I think legally, there is a law that says if you invite people to work on your property, you have to ensure that the property is safe. That sounds like a common sense law to me.
And google, lots of delivery men sue people for tripping/falling at their premises:

If you have a family to support, if you have bills to pay, if you're out of pocket over this and if you are sure it's the customer's fault and you weren't just a clumsy gimp, give the No win no fee dogs a ring.

I also wonder if you would say that to my face? It's easy to be racist to someone on the other end of a keyboard.

It's all very well people telling you to sue.
But did you not think to apply common sense to the situation before you put yourself at risk?
If I see something that looks unsafe I make the decision not to go near it.
Put it down to experience and move on, and best wishes for a quick recovery.

The guys who I had a run in with over my van signwriting and also an awful company called Tayna Batteries (avoid, by the way - see my post http://www.cleanitup.co.uk/smf/index.php?topic=155858.0) would, I would have thought, have wished they'd have avoided confrontation with me. You are quite within your rights to relate the story and let all and sundry know just what sort of people these awful custies are. Their neighbours (if you clean them), people across the street. In fact everyone you can be bothered to relate the story to. Word will eventually get back to them and they might start to regret it.

Yes I would agree that the customers response to the situation was appalling.
But I think the window cleaner has to accept some personal responsibility for his own actions.
If it was me I would of decided not to go near the pile of rubbish in the first place and if the windows couldn't be reached, so be it.
I also wouldn't bother slagging the ex-customers off to neighbours..................it makes you look weak and as if you are looking for sympathy.
I can't really see any positive motives for doing that. So what if the ex-customer does inherit a sense of guilt?
That isn't going to change the situation, and they have already shown their true colours so you wouldn't want them back anyway.
Man up! And replace the dastardly buggers with 2 new quality customers! ;D

I turned to go to the front door to tell the owner I cannot clean with the mess and fell on my back and whipped my head back onto the concrete path.Were I lay unconscious for I do not know how long. When I got up and managed to reach the front door I said to the daughter how can you folks leave the walk way so clutter.I have just injured myself.Her ply was you should look were you go then closed the door.I sat on the pavement for about 10 minutes and drove to hospital. How i got there I do not know.I have spoken to them about the cluttered garden and even offer to help put it strait. Answered. NO
I think they are very self centered people and spoiled kids that have to much.

I think they are very self centered people and spoiled kids that have to much.
I must say until this point I was thinking "let it go" - but there is part of me that would threaten to sue. I would enjoy the thought of them squirming when they get the solicitor's letter.
The problem is is that it would be for "revenge" and experience tells me that when you hate someone that much you end up digging two graves.
So unless my family needed the money desperately because I was so badly injured I could not work I would let it go.

To sue someone you have to show they had a 'duty of care', and that they failed to fulfill it. If they've loads of cr~p down their side alley that is clearly visible, have they failed in that duty of care? I don't know.
If something fell on you out of a window then maybe, but you could see the stuff before you started.
I was thinking if you knocked before you started and they said 'go ahead and clean my windows' then I think it could be argued they invited you onto their property, and they then became responsible for making your work area safe.
Interesting.
It's a shame you hurt yourself and they were turds for their attitude, so it's probably worth a punt just to cheese them off.

Yes, but I'm obviously not having a dig at anyone; apart from myself. That's the difference.
Still, if anyone has a problem with the moderation, all they need to do is to hit the report to mod button, and all the mods, and the site owner gets an e-mail.

I agree with Tosh the comment was racist as there was no context to explain it.
With regards the fall, you have to prove negligence first which is easier said than done. Also, the claim to take anything upto 5 years.
I sued a company when a chair I sat on collapsed and I fractured 3 bones in my neck. The company already knew those chairs were faulty as 3 had done the same during the previous year yet they had done nothing about it. My claim took just over 4 years.
Negligence is my case was easy to prove but in someone's garden who has kids? If the risk of walking through all the junk could have resulted in an accident then by rights, don't walk there, but in reality, life ain't like that.
I stepped backwards today and fell over a large flower pot onto the grass. Really, I should have moved them before I started cleaning the windows.
Still, it's sounds a pretty nasty accident though.

Do we know have to put our race, colour, creed, sexuality, origin of birth and anything else we feel may be relevant into the column on the left so that before people make a comment on us they will know that they will not offend!!

Unfortunately, Ste, it's my subjective interpretation of the incident that matters. I ran it through the site owner via the 'report to mod' (which anyone can use), he agrees, so I'm happy enough with the situation.
If you wish to be a mod because you're unhappy with the standard of moderation, I'd be happy to welcome you to the team; just contact the site owner (you can do this via the report to mod button) and ask.
The pay isn't very good mind. :(

How can you say that? You don't know everyone else's ethnicity. And I can be as offended as you if someone called you by a racist term, if not more so.
Even as being half Japanese, you could offend me by making Japanese jokes. It's not about you, it's about a race of people and racism.
Black people can be racist towards black people and it offends white people. I thought you'd know that.

I'm half Scot half Swedish and born in Scotland but bought up in London.
I've only ever had the mickey taken out of me about the Scottish part and never about the Swedish part.
I'd like to complain that I've never had a single racist comment made to me about the Swedish part of my ancestry even though Abba come from the same land.
Seriously though, maybe history plays a part in what is racism and what isn't.
Also, culture plays a part as well. In the UK we all have a similar culture so calling a Scot a 'sweaty sock who is very mean' means, in terms of racism, something very different to an isolated comment about 'Asians are expert at making claims'.
