Has anyone submitted a money claim on line through the HM courts and tribunal services?
-
Yes.
Twice. Once went to small claims court. Second time claim was awarded to me because the other party did not give all the information and they subsequently settled the claim. Neither was a window cleaning customer though. One was a second hand car dealer the second a supplier of wfp equipment.

Not taken anyone to court for business reasons. If it goes to court and they decide to defend, then I have to attend, at which point I've lost an absolute minimum of half a day's work. Just not worth it.
More positively, what I do manage is not to let people get behind on payment. That's helped by six-weekly cleaning (more time to chase) and a twice-weekly run of reminder letters. If you do it regularly, it becomes just business and you don't get emotionally involved.
If I did let a customer get to £160, it might just be getting to a point where I'd consider it. However, I might well still take the view that I'm better spending my time earning from people who will pay than chasing someone who didn't pay.

i appreciate your opinion . my main issue with the custy is they have taken me for a fool and i dont want them to get away with it so im prepared for having time off (easy when you re a windy cause there is always saturdays) im just not lying down on this one

Yes. The MCOL website is great. Very easy to use straight forward. Wouldn't hesitate in using it again.

I have found very good and won everytime for getting money back, also the customer is also charged the minimum £30 fee on top, and nearly all have settled before court case in full plus the £30 fee. Also in Teesside, telephone arbitration takes place, sometimes with an offer before, but mostly the court documents work, and customers are threatened with a possible ccj, and are frightened with this

Make sure you send any debtors a 'letter of intent' prior to starting any court proceedings. I believe from what I can remember that you have to give any debtor 14 days officially to clear a debt or offer terms to settle it prior to starting court proceedings, however old the debt is. Once the 14 days is up you fire in your claim online. You will receive a copy via email of what documents have been generated by the system on your behalf and what the debtor will be receiving. Its very self-explanatory and easy to follow system.

Thanks for the advice, I have started a claim on the MCOL website, do you mean I should have sent a letter before that, or before it goes to court if it goes that far?
Thanks

Before you put the claim in, otherwise the court will view that you haven't given them opportunity to pay.

The 14 day notice of court proceedings is essential. If it goes to court and you haven't given it you will lose. Is there a way of cancelling it and restarting?
-
It can be cancelled at any point online. This is allow the fact that most people pay up when they get court proceedings in the post.
However, if you do that you can probably just start again, this time using the 'letter of intent',
-
get the letter sent now because they dont issue the proceedings for about 3 weeks i think after u start it all
-
I've got a letter written tonight ready to be posted tomorrow :)
-
7 days the notice is only needed from the later dated not received
