Title: unpaid commercial work
Post by: Cleaningcaddy on October 18, 2011, 04:37:08 pm
I did a Gutter Job for a large organisation back in May 2011 and have still not received payment I have contacted them, phoned, sent emails Invoice reminders and keep being fobbed off with " yes where dealing with it sorry for the delay" don’t want to mention the company but I am just wondering is there a organisation or company who chase the payment and take a percentage for their work?

Give them one more warning letter saying if payment not recieved within 10 days you are going to court. Then go to moneyclaim online and follow the simple steps. they will pay.

Just filed for a CCJ for a £3000 outstanding debt, 4th one in about same number of years, never failed to receive payment yet, don't expect this one to be rejected either.

Interest and compensation,
interest calculator is available on line and comp is around £40 per invoice, so always make out seperate invoices for all jobs done.
add this to bottom of your invoices;

We understand and will exercise our statutory right to interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms.

that way when you bill them for interest and compo they cannot complain.

here's the best web for help and advise....

As long as you do state and agree with the clients how many days Invoices should be paid by, Mine are 30 days, which I think is pretty much standard. I just point out this fact to any new client.

As for domestic non payers its the same standards really, when you took the job on, they employed you and you agreed terms (or should have done) pay when done ect via bacs, cheque or cash.
I have a small leaflet that I post thru their door when they owe more than twice, which simply states that their account is now in arrears, asking them to post their payments asap, if I dont hear from them, next time I go I put a similar one thru the door stating that we are now adding interest on, and will without further notice start legal proceedings if not paid within 7 days, usually works.
But I always door knock a few times first, Sat mornings are a great time to catch them in I find.
NEVER EVER let them get away with it! You do this for a living, these are your wages!
Good luck.

For ORI.....
here's the bottom text from my invoices....

ALL INVOICES MUST BE PAID WITHIN 30 DAYS OF ABOVE ‘INVOICE DATE’
We understand and will exercise our statutory right to interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to agreed credit terms.

Can i really hire people like thomas higgins to take mrs higgins to court because she did not pay for our services for the cleaning of her windows for £12?

what will it cost me and will i actually recover costs?
cheers

I'm sure a solicitor can do a very fine job of debt collection. But all they will do is go down the route if claiming your money back for you via the courts. Which is what this does https://www.moneyclaim.gov.uk/web/mcol/welcome

It couldn't be simpler, you get court costs back, can impose an interest charge and all is dealt with online. Submit your claim, 2 weeks later if the debtor hadn't responded you can submit judgement and the debt is then enforced. If they don't respond to that they get a summons to appear in court to answer your questions about their finances and why they've not paid.
