i had a lad start at beginning of april, and he has caused me no end of problems, it was all done properly thru the books etc, the reason im getting rid is he said he would be in on 2 saturdays and failed to turn up when upvc jobs had been booked in, and hes also failed to turn in on 3 other days without any real explanation.all this is first 3 months probationery period
now during april and may i have gave him all the bank holidays off paid, he then had a weeks holiday booked in june which i have gave him off, now being fairly new too employing thru the proper channels i am after some advice regarding holiday entitlement.
do i have too pay him for all the bank holidays or can i take them from the holidays hes accrued.which is prob around 3-4 days over 3 month period.all it is its pay day today for staff and id like to know where i stand. iv not really made any profit from him during his employment due too all the bank holidays/2 days on nvq/and days off hes not turned in for etc

We give 28 days holiday,if there's 7 bank holidays that leaves him with 21 days of he's own,he gets 2.3 days for every month he works for you

When you sack someone without notice,and worked under a year,you have to give them a weeks money in hand

i started a job a couple of years ago, worked a week then i was really ill.
i got £9 per day sick pay for 1 week, that i had to get a sick note for.
then sacked, as i was going to be off sick for 5-6 weeks. thats all.
if its in the probation period, i think it would be the same. dont come back next week your sacked.

We sacked someone a few months back,he went straight for legal advice,and that's what we had to pay him,we could take off any holidays we had payed out of the week in hand

lyndy im not sure that is correct, has an employee can you keep is week in hand if he gives no notice??
If you are sacking him for a a real reason and it is stated he was on a three month trial you can just get rid, is trial was unsuccesful.
has for holidays its 28 days a year min which can include bank holidays, so if he has had a week off anfd the bank holidays he has been over paid so take it out of is week in hand.
just thinking about what your saying Lyndy, you had to pay them a week in hand but that was there money any way, thats what a week in hand means.

Just spoke to the wife,we had to give him he's week in hand plus another weeks pay,our guy wasn't on a trial he worked for us for 9 months,you can get rid of anyone without notice up to 12 months

lyndy i thionk youll find your wrong you dont have to give some one 12 onths notice.
why would you have to pay some one for work they havent done??? if there owed holidays a different story but i assure you you dont have to pay someone a extra week after there week in hand??

he's saying you dont have to give them notice if its 12 months or under...not give them 12 months notice :)

Look into it ronnie,we had to,he took advice from citizen advice,they rang us up and told us we had to pay an extra weeks pay.because we didn't give him notice just sacked him on the spot

i have i know from experience, if you have good rights ie there is previuos things that have resulted to the sacking then your with in your rights if you have just sacked him for nothing im suprised he didnt take you further for more than one week.

You don't have to pay holidays, as long as you put in in the contract. for jobs like a window cleaner I would say no paid holiday in the first year. Or one day a month pro rata.

I've just had the exact same problem, almost identical to a tee. >:( >:( >:(
FFS get new staff on a ZERO HOURS CONTRACT...it covers your a$$ if it goes bad with staff. ;)

i know im being lazy here but do u have a website or info u can point me towards ref these zero hour contracts as going this way when I expand operations and never come across a zero hour contract before ? thanks :)

When you take someone on, do it on a 3 month trial to see if they are suitable. Under 12 months you can get rid of them. Holiday pay is accrued from the day they start at 1.6 days per month worked. Bank Holidays are payable . So everyone is entitled to 20 days holiday per year plus 8 Bank Holidays = 28 days. If they work 9 months then that is 9 x 1.6 days = 14 days paid holiday. Take off the time he has already taken and that is what he is owed. His weeks notice money should come out of this if he finishes immediatly. Hope this helps. Always put someone on a rolling temporary contract after the 3 month trial and keep a holiday record.

I agree with previous posts as to ACAS. It isn't an issue you can take lightly so just phone them every time, at the end of the day it's free and it's quicker than posting on here and waiting to sift through the responses plus then you know you're getting the right info'

denise do you know where i stand then because iv paid him for all the bank hols and 3 days holiday so hes basically had 11 days paid out of 28 in the first 3 months

if im reading this correctly hes worked 3 months which is 3 x1.8 = 5.4 days entitlement plus his bank holidays which are statuory paid so approx he owes you half a day or so by my calculation
jusy pay him and move on :)
