just looking on the net at this, found some very interesting things....
there is a bit were you can check the availability - its says no company registered under clear view - there must be over a 100 clear views around!
im not called clear view, i was just checking a few names out....
so if one guy was to register that name what does it mean for the rest?

You only register a name if you are a limited company.

hi i am no expert on this but this is how i understand it if you register your company name with companies house you own that company and the name buy law nobody else can trade under that name.
but many do or they just use different variations of the name clear view ltd or clear view,cleaning, systems, window cleaners ect
and there are loads registered on companies house.

It is a good idea when starting to do a search of your chosen business name in all the local areas, as it would be a bad idea to use the same name as somone else local.

What if you were in a different line of business? Let's say you were Marks and Spencer car manufacturers? Or even a long way away from a same named company?
I mean, if you called yourself Ionics, but you made cakes and were based in Shetland, would that be ok?

you only need to register with company house when you go Ltd, it cost me £140 but that a while ago
once registered thats it the name is legally yours and use of it by any other person than those named as directors face prosecution.
until then you are in the wash and anyone can use your name, sure you can take the other party to court but it would hurt your pocket to do so and with no 100% guarantee you would win

You can trade under any name you like but no-one else could claim to be 'yourcompany limited' once you have registered it.
A limited company can trade under any name it likes also, for instance 'The Boots Company PLC' trades as 'Boots' our high street chemists.

There is an important distinction between the official title of the company and the name under which it may trade.
It is possible to for a company to be registered under ABC Limited and then start trading as the business name XYZ . The main difference between the two is that the name ABC limited is regulated by Companies House, and as such, only one such company may be set-up with it.
XYZ however, belongs to the realms of trademark legislation and business names, which are generally far more difficult to monopolise. In order to register a trademark, the business must demonstrate that the name is firmly associated with them in the eyes of the public or other group relevant to their activities.
Thus, even if a company has incorporated using XYZ limited, this would probably not prevent other businesses from trading as that name. There might be legal ramifications should it be judged that one business is passing itself off as the other in order to gain trade unfairly.
The Companies Act 2006 introduced new provisions which came in to effect on January 1st 2007 requiring all websites to display certain additional details. This extra information includes the name, company number and VAT registration code of the corporate owner of the website.
Although these amendments did not diminish the capacity of companies to trade as another business name, it does increase the transparency of the relationship and thus, might result in less confusion as to who the visitor is engaged with.
My company is AFSystems.co.uk Limited and I trade as 'AF Systems' but I also trade as 'Carpet & Upholstery Care' and 'Stafford Window Cleaning' there is nothing illegal about this as long as I declare that these companies are all the same.
You could have 2 people living next door to each other trading as window cleaners both trading as 'Bob the windie' and there is nothing either could do about it. It may be a little confusing for the customer though!

You can also register a name if you want to stay a sole trader you just don't trade through the limited company and keep your accounts dormant. you still have to submit dormant accounts every year though.
