Title: Guys who employ do staff complain?

Regarding wear on elbows back pain neck pain basically things some of us put up with day in day out.

we don't complain because we are our own boss and its normally worth our while.

But if you are paying someone a wage and he is working 8 hours a day 5 days a week, as your income improves so his health ie elbow pains etc becomes worse to the point he wants time off , then possibly a claim?

Anyone has some experience with this? is this a case of making sure you have employers insurance,and get him to sign advice forms about stretches, ?

Has anyone had staff claim against them? 

Has anyone heard any storys?

Maybe you are worried that your staff might claim against you ?then again maybe you would be prepaid because you have employers insurance and follow hse and would be prepaid if this was to happen.

That's compulsory.
Right with regards to neck pain and back pain, they should be fit for work!
What would happen if you were in the building trade, carrying hods of bricks and you kept having time off because your shoulder and back ache? they would get someone else as you wouldn't be fit for that position.

Yes we have duty of care, but the employee also has a duty to care for himself too.

sad to say Matt that the world no longer works that way - if the employee wishes to make out
that the pain is caused thro work this leaves you open to a claim - might even be as simple as the employee
uses a brodex ali pole at 4kg and you could have got them an slx at 2kg
it leaves an avenue open to claim as you (the employer) have not done everything possible to prevent
the problem


people can do stupid things etc...  and still get compo from an employer - it's a mad world !

iv just taken on 2 deaf lads part time . i took advice from the deaf council ,and its still early days

 the main thing is to try your level best not to have anybody rushing.sure its what this game is about,being quick, but my trade off is that im doing the ladder work while the lad is doing the ground floor .  although ive got insurance for them to use a ladder its too big a claim gamble for the early days

theyve been pounding the streets leafletting and brought in no end of new work which is good . also ive a feeling theyre very grateful for a chance which is so lacking these days .

 only yesterday a man  washing his van where i was working had a 5 minute chat with me-he would be a claimer type for sure, was going on about would he get any money doing my job if it was raining etc

As someone has already said, the employer has a duty of care for his employees. As long as you do your best to look after their health, you can't do any more. This means getting your H&S policies down and signed by each employee, swapping roles during the day to try and avoid RSI's, training courses on how to lift/work at height, sun cream in the spring/summer etc etc.
A few guys on here used to employ and went back to working on their own cos of the hassle. Others do very well so I guess it's an organisational thing.

Thanks for the replys , when the day comes i will make him aware and get him tio sign something regarding health, make sure he uses a clx or an slx, its true cos i wouldnt use any other pole. and give him as much advice as i can.

but its true thou builders labourers would get similar pains so i guess we just need to follow guidelines

what i do  is take folk on who are all ready on the sick then they carnt claim compo ;D
