Title: buying work/employing

hi guys,
in the next week or two i am buying a lot of work off a guy which includes taking on 4 staff.
can anybody help out with things i,ll need,ie employers insurance ect??

and any thing else i may need to consider??

Maybe it would have been best to find out what was needed before taking on 4 staff  ???

You would be best off looking at the HMRC website for guidance.

be careful as am sure if you ahve more than 5 employess,  then u have to do recored  risk assessment for every job,  plus you ahve the 2p rule,  where u can change the contracts,  check what holidays they have had and what theya re owed are you will ahve to pay them

as for holidays ect, i am not buying the whole business so they will be starting from day 1.

plus once you have 6 or more employees you have to have a health and safety officer, they have to do courses and things which you have to pay for

get it checked, as all depends on how they read the law,  as if you are getting there work and they are coming with it  then u r just taking over there employment,    r u buy vehicle as well

You will be required by law  this year to have a pension provision for them and one way or another  it will cost you money and lots of your time.

i am having 2 cars as part of it but they are fit for scrap,

i have heard about this, i thought you had to suggest a pension to them rather than offer them one??

i am very lucky in that i have several people around me who will give me a lot of help with it all.

sounds like you will need to tupe the employees over which includes current contracts they ae on, also if you need advice regarding pensions then i know a guy whos soon to be doing mine, admittedly its early days but he does know the ins and outs thats required, either way good luck,

I would employ all of them on a self employed basis. Not employees.

Then you can re negotiate a new contract for them if you want to take them on as employees at a later date.

You will only need to have a Health & Safety Advisor which can be an outside organisation you sign up to. You wont need one to be working for you. Then you as Boss will direct all Health & Safety Matters.

Staff will let u down and mess you about. Are these the staff you want have you done an interview. They may be useless and will bring your business down as they have no loyalty to you.

Personally I would interview them them them the score if your gut feeling is to give them a job or not.

How do you take them on as self employed, surely they have to be working for more than one person ? or they will be employed.?????

Thats not correct. They can work for as many people as they want.

You can contact HMRC and say you will be taking on some self employed WC. You cant guarantee them a set hours per week. They will be working under their own direction.

I employ men under CIS where I simply deduct 20% from their money which I pay across to HMRC.

If they become an employee you have to pay them every week even for time they are rained off or frozen off, Holiday, Sick, etc etc

Give them a good wage and most men would prefer self employed

u need to check with HMRC as they changed the rules,  if you provide va, work and tell them when it has to be done they are employed

wouldnt the best person to talk to about this buissines be the guy you are buying the work of he may be realy helpfull and sort you out

on another note i got ofered some work 3 months ago for free4 men 2 vans both 2000 reg
the chap wanted to retire i looked at everything 5000 monthly incom took all paper work to my accountant and found out if he closed the buissnes i would cost excess of 40,000 in redundancies etc etc  some of his contracts are not transferable very hard to sell a bussines with some ones name

Lili has been a great help to me in setting up the employment side of things. It's also good to have a proper qualified employment lawyer on-side should anything go wrong, although I'm sure it wont.

its all happening now gav, paid the guy a depoiset 2day, starting work tuesday,

had some good advise from sir david morris,

its a bit daunting but am fairly confident.
