Apologies To Albright & Shiny
« on: March 07, 2014, 11:42:09 pm »
Hi,
Reference my previous posts regarding me copying Jim`s artwork. I have apologised to Jim regarding this but it was a genuine mistake. We have sorted it out now. Its hard to find a name that hasn`t been used already as there are so many window cleaners about.
I have been on this forum for over a year now and got loads of advice. I wish I had asked about picking a name! I hope you won`t judge me too harshly over this because I meant no harm.

I wouldn't worry about it.

You could just name yourself 'clear view' like everyone else.  ;D

I don't think it was just the name - it was the blatent rip off of the colour, the style and the logo then the claim that it looked nothing like Jims.

My trading name has popped up all over the country in similar form but never has the design been copied as far as I'm aware.
One local idiot copied my name, built a website in my name and simply inserted his own phone number although trading as someone else.

The other thing that winds me up is when you do a google search for say Pure Freedom and and up on Ionics sister website  >:(

He'd bought up all the domain names similar to my website then tried to sell them to me when I complained. When the terms had run out he phoned again and offered to transfer them to me (free). I don't need them so declined.
Water under the bridge now I suppose but I don't forget.

Individually you can't . Combine them and register them with the Intellectual property office as a trade mark and you can.. Its a costly process to register the trade mark but If you want to keep your branding then its essential

Same goes for logos and art work. Its covered by copyright if its designed specifically for you and once registered with the IPO its a trade mark...  This orange man is specific to me and was designed for me specifically.. as was the rest of my branding..
Look at virgin. a common or garden word. their logo is the written word Virgin designed specifically for them. Yet its one of the big exclusive brands in the UK. Quaker oats.. two common or garden words. Linked and trademarked.

Once trademarked no one else can legitimatley use them

All done and dusted now and a big bit of respect to Steve for declaring it as  a simple mistake and lack of knowledge of the legislation around trademarks and the like at the earliest opportunity..  .

There is one positive that I can take out of it.. The livery does what its supposed to.. Its attracts people to it.. Whats that saying "Imitation is the greatest form of flattery" lol

We've got two Squeaky Cleans in Chepstow, which makes me smile.  Crystal Clear seems to be quite popular around these parts too, and not just for window cleaners, there's a double glazing company here called that also.

We call ourselves "The Window Cleaners", and I bet loads of your customers refer to you as that too, which is really annoying!  >:( >:( >:(

One time, after looking at ex rac transits, and it occurred to me that putting the rebel flag on the roof a large 01 on the side, and calling yourself 'hazard county window cleaning' would be pretty funny, and get lots of attention ;D

Alas i had already been cleaning windows for quite a while by then ;)

There is a company trading as 911virgin (sells pre owned Porsche's) they received a letter from Virgin highlighting the need to ensure clients are clear it is nothing to do with virgin itself, other than that they continue to trade.

There is (or was) a second hand shop in Rainham, Kent that called themselves "'Arrods".  The real Harrods threatened them with legal action - as if they could possibly be any threat to them.

The shop retaliated by changing their name to "Not 'Arrods" ;D
